Indenture bet Edward Anderson & Garrett Oglesby 04 May 1841 Wilkes Co, GA WILKES COUNTY, GEORGIA, DEED BOOK 000, p. 380 This indenture made the fourth day of May eighteen hundred (and forty- one), it being the first Tuesday in said month, between Edward R. Anderson, Sheriff of Wilkes County and State aforesaid, and Garrett Oglesby and John Wilkerson of the same County and State. Witnesseth that whereas the said E. R. Anderson in obedience to a writ of foreclosure issuing from Wilkes Superior Court, Gibson Hopkins vs. Thomas I. Oglesby and Joseph L. Oglesby and Jephen A. Johnson, did seize and _____ upon one tract or parcel of land situated, lying and being in the said County on the waters of Broad River containing one hundred and sixty-three acres, more or less, adjoining lands of Nimrod Waller, James Littleton, and others whereon the said Thomas I. Oglesby now resides and, after duly and publicly advertising the same agreeable to law, did set up and expose the same to public and outcry before the courthouse door in Washington, Wilkes County, with the legal sale ____ when the same was knocked off to the said Garrett Oglesby and John Wilkerson for the sum of five dollars to the (said) Edward R. Anderson, Sheriff as aforesaid, paid at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath bargained and sold and, by these presents, doth bargain and sell unto the said Oglesby and Wilkerson, their heirs and assigns, all the above described lot or parcel of land together with all the appurtenances thereunto belonging or in any wise appertaining to the same to their heirs and assigns forever in fee simple. And the said E. R. Anderson, Sheriff as aforesaid, will forever warrant and defend the rights and title to the said tract or parcel of land against the claim of the said Thomas I. Oglesby, his heirs and assigns, or against the claim of any other person or persons so far as the law authorizes me as Sheriff aforesaid. In witness whereof, the said E. R. Anderson, Sheriff as aforesaid, hath hereunto set his hand and affixed his seal the day and date within written. (The words "it being the first Tuesday in said" interlined before assigned.)
