Indenture bet Joseph Burks & Garrett Oglesby 13 Jan 1831 Wilkes Co, GA WILKES COUNTY, GEORGIA, DEED BOOK LLL, p. 449 This indenture made this 13th day of January in the year of 1831 between John Burks, administrator of the estate of Joseph Burks, deceased, of the one part and Garrett Oglesby of said County and State of the other part. Witnesseth that whereas the said John Burks, administrator as aforesaid, in obedience to an order of the honorable Inferior Court while sitting for ordinary purposes at the September term of said Court in the year 1829, advertised by public advertisement to sell the real estate of said Joseph Burks, dec'd., and, in conformity to said order and advertisement, did offer for sale at public outcry at the Courthouse in said County on the first Tuesday, in this instance the tract of land described herein, when Wiley P. Burks became the purchaser at and for the price of eighty dollars, his being the highest and best bid obtained, and the said Wiley P. Burks having directed me to make titles, the said John Burks, administrator as aforesaid, his order in the following: John Burks, administrator of the estate of Joseph Burks, dec'd., You will make the deed for the above 142-1/2 acres of land to Garrett Oglesby which I purchased at administrator's sale on the first Tuesday in January, 1831. Am oblige yours. Wylie P. Burks And, for the sum of eighty dollars to me in hand paid at and by the said Garrett Oglesby, I, John Burks, administrator aforesaid, do grant, bargain, sell and convey unto the Garrett Oglesby all that tract or parcel of land situated, lying and being in said County adjoining George Oglesby, John Burks, and others containing one hundred forty-two and 1/2 acres. Together with all and singular the rights, members and appurtenances thereunto belonging or in any wise appertaining unto the said Garrett Oglesby, his heirs and assigns forever. And I, the said John Burks, administrator as aforesaid, will warrant and forever defend unto the said Garrett Oglesby, his heirs and assigns, against the claim of myself, my heirs and assigns, and against the claims of all other persons whatsoever as far as the law authorizes me as administrator as aforesaid and no further.
