Reese & Mary R. [Reece?] Cozart as Executors upon the Last Will of Green P. Cozart of said County deceased of the one part and Enoch G. Binns of said County of the other part. Witnesseth, that whereas said Green P. Cozart in his lifetime bound himself to make title to said Enoch G. Binns of a certain tract of land lying situated and being in Washington, Wilkes County, Georgia, adjoining lots of Lowe Brothers, Robert Toombs & the street separating the lots of B.F. Jordan and W.M. Reese the same being the place sold by L.W. Wynn guardian of D.G. Cotting and by Cotting to M.G. [Milton George] Robert and by Robert to Cozart, and after the execution of said bond forfeited, departed [died] before the fulfillment of its conditions and whereas the said Enoch G. Binns has fully performed the conditions on which said G.P. Cozart was to make a title and in accordance to law has filed his petition to the Court of Ordinary of Wilkes County, and obtained an order after due notice that said W.M. Reese & Mary R. Cozart as such Executors of said Green P. Cozart should carry out said bond & make title of said land to said Enoch G. Binns. Now, in consideration of the premises and in order to execute said order of the Court of Ordinary of said County of Wilkes the said W.M. Reese & Mary R. Cozart as Executor of said Green P. Cozart Estate granted bargained sold and conveyed and doth by these presents grant, bargain, sell and convey unto the said Enoch G. Binns his heirs & assigns all that tract of land hereinbefore described to have and to hold in fee simple, with all the rights, privileges and appurtenances to the same in any wise appertaining or belonging in as full and absolute a manner as the said Green P. Cozart could do were he in life. In Witness whereof the said W.M. Reese & Mary R. Cozart as Executors of said Green P.
