Thomas http://www.genrecords.net/emailregistry/vols/00016.html#0003785 August 19, 2008, 8:15 pm Written: March 1, 1823 Recorded: December 9, 1823 Deed Book HHH Page 205-206 Negroes - Mortgage Georgia Wilkes County This Indenture made this Twenty first day of March Eighteen hundred and Twenty three between Dudley Stinson of the County and State aforesaid of the one part and William Dearing of the Same County and State aforesaid of the other part, witnesseth, the said Dudley Stinson hath this day made and delivered to the said William Dearing his certain promissory note subscribed with his hand and bearing even date with these presents whereby the said Dudley Stinson hath promised to pay the said William Dearing or bearer on or before the first day of January Eighteen hundred & Twenty four, the sum of nine hundred and ninety one dollars fifty four cents with interest from the date Now for & in Consideration of the sum of five dollars by the said William Dearing to the said Dudley Stinson in hand paid the receipt whereof is hereby acknowledged as well for the better ______ing the payment of the aforesaid note the said Dudley Stinson hath this day bargained and sold & doth by these presents bargain & sell unto the said William Dearing his heirs and assigns the following property to wit A negro man [Sam is struck through] by the name of Sam about twenty two years old, a negro woman by the name of Nancy between nineteen and Twenty Years old a negro boy Hope about Eleven Years old. Provided nevertheless that if the said Dudley Stinson his heirs & administrators __ shall and do well and truly pay or cause to be paid unto the said William Dearing his heirs and assigns the aforesaid Sum of nine hundred and ninety one Dollars 54/100 cts with Interest on the day and time appointed for the payment thereof in the said promissory note mentioned with Lawful Interest for the Same according to the tenor of said note then and from thenceforth as well these present indenture and the rights to the property thereby Conveyed as the said promissory note shall cease determine and be void to all intents and purposes by the way of mortgage. In Testimony whereof the said Dudley Stinson hath this day set his hand & seal, the day and year above written Signed Sealed and acknowledged in the presence of Dudley Stinson {Seal} Seaborn J. Mays $991.54 on or before the the (sic) first day of January Eighteen hundred & twenty four I promise to pay William Dearing as or bearer nine hundred and ninety one dollars 54/100 cents with interest from the date for value Rec’d March 21st 1823- Dudley Stinson Georgia Wilkes County Personally appeared before Seaborn Mays who on his oath saith that he saw Dudley Stinson sign the foregoing instrument and acknowledge the same for the purposes therein contained and that he signed the same as a witness Sworn to before me Seaborn J.
