Wilkes County Deed Book II, page 39

This Indenture made this twelfth day of January in the year of Our Lord one 
thousand seven hundred & ninety one Between Benjamin Hart & Ann his wife of 
Elbert County & State of Georgia of the one part and Humphrey Tomkins of Wilkes 
County and State aforesaid of the other part Witnesseth that the said Benjamin 
Hart and Ann his wife hath for and in consideration of the sum of One hundred 
pounds Sterling to them in hand paid by the said Humphrey Tomkins the receipt 
whereof is hereby acknowledged Hath granted bargained sold & confirmed and by 
these presents do bargain sell and Confirm set & make over unto him the said 
Humphrey Tomkins All that Tract or parcel of land Containing Two hundred acres 
Situate lying and being in the County of Wilkes State aforesaid on the waters 
of Goose pond Creek Butting & Bounding viz. Northwardly by McGehees Land 
Southwest by L_____s South East unknown and which fully appear from a plat 
annexed to a ____ lot ____ ___ ____ ___ thereto may more ___ appear with all 
and Singular the Rights members and appurtenances thereof whatsoever to the 
said Tract of Land belonging or in anywise appertaining and the Remainders 
Rents issues and profits thereof. To have and to hold the said Tract of land 
and all and singular the premises aforesaid with their and every of their 
Rights members and appurtenances unto the said Humphrey Tomkins his heirs and 
assigns to the only proper use and behoof of the said Humphrey Tomkins his 
heirs and assigns forever and the said Benjamin Hart and Ann his wife the sd. 
Tract of land and premises and every part thereof unto the said Humphrey 
Tomkins his heirs and assigns against them the said Benjamin Hart & Ann his 
wife their heirs & all & every person or persons whatsoever shall and will 
warrant and forever defend by these presents In Witness whereof the said 
Benjamin Hart & Ann his wife have hereunto set their hands & seals the day & 
year above said –
