Copied at the Wilkes County Courthouse in Washington, Georgia, September 2006, transcribed by Marshall Styles: State of Georgia} Wilkes County} This Indenture made this 19th day of December in the year Eighteen hundred & thirty six – Return Albert Rees Administrator on the Estate of Augustus H. Gibson – deceased of the one part and Francis Colley of the other part all of said County & State Witnesseth – That the said Albert Rees Administrator as aforesaid in obedience & in conformity to an order of the Honorable Superior Court of Said County, sitting for Ordinary purposes did advertise by public advertisement agreeable to Law to Sell part of the real Estate of said A.H. Gibson, deceased, and in conformity to said order & advertisement did offer for sale at public Outcry at the Court House in said County on the first Tuesday in this instant, the Tract of Land described herein, when the said Francis Colley became purchaser at & for the price or sum of Twenty Eight Hundred Dollars his being the highest & first bid obtained. Now for and in consideration of the said sum of Twenty Eight Hundred Dollars to me in hand paid by the said Francis Colley, at or before the Sealing & Delivering of these presents the receipt whereof is hereby acknowledged, I have granted bargained sold & conveyed and by these presents do grant bargain sell and convey unto the said Francis Colley, his heirs & assigns forever All that Tract or parcel of Land situate lying & being in the County & State aforesaid on the waters of Fishing Creek adjoining Charles L. Bolton, John T. Laughter, Micah F. Lane, Alexander Pope & Estate of Willis containing Eight Hundred & Twenty Acres, more or less, having such shape marks courses distances, etc, as will fully appear by reference to the following Deeds, two from Silas(?) H. Echols to Augustus H. Gibson, one from the Executors of John Ray, deceased to Augustus h. Gibson, one from Alexander Pope to Augustus H. Gibson, one from Jenny Laugher to Augustus H. Gibson, one from David Hillhouse, one from the heirs of John Edwards deceased to the same Augustus H. Gibson, all recorded in the Clerk of the Superior Court of Wilkes County except the one from Hillhouse to Gibson. Together with all & singular the rights members and appurtenances to the same belonging or in any way appertaining, To have & to hold the same to the said Francis Colley, his heirs & assigns forever – And I the said Albert Rees Administrator as aforesaid, the Tract or parcel of Land & all the rights members & appurtenances to the same belonging or appertaining in any way will warrant & forever defend unto the said Francis Colley his heirs & assigns against the claims of myself my heirs and assigns and against the claim of all other persons whatsoever as far as the Law authorizes me as Administrator as aforesaid & no further.
