Copied at the Wilkes County Courthouse in Washington, Georgia, September 2006, transcribed by Marshall Styles: Georgia} Wilkes County} This indenture made this fifth day of November in the Year of Our Lord Eighteen hundred and fifty between John W. Heard of the County and State aforesaid of the one part and Spain Colley of the same place of the other part & Witnesseth that the said John W. Heard for & in consideration of the Sum of two thousand dollars to him in hand paid at & before the Sealing and delivery of these presents to the receipt whereof is hereby acknowledged hath granted and sold and conveyed and doth by these presents grant bargain sell and convey unto the said Spain Colley his heirs & assigns all that tract or parcel of land situate lying and being in the County aforesaid on Beaverdam Creek, containing two hundred and fifty nine acres, two Rods and 3-2/10 Poles, more or less, known as part of the Land whereon the late Garrett Newman dec’d formerly lived, said land is described as follows: beginning at a pine stump, thence to a pine and thence to a white oak, thence to a pine tree, thence to a Spanish oak, thence to a maple on branch and thence to the pine stump to beginning corner, said land adjoined the land of J.I. Irvin dec’d, James I. Lane & others. To have and to hold the said tract or parcel of land unto the said Spain Colley his heirs and assigns, together with all and singular the rights members and appurtenances thereof to the same in any manner belonging or appertaining, to his & their own proper benefit & behoof forever in fee simple. And the said John W. Heard for himself his heirs Executors and administrators, the said bargained premises, unto the said Spain Colley his heirs & assigns with warrant & forever defend the right & title thereof against themselves and against the claim of all other persons whatever.
