Indenture bet Garrett Oglesby & Reubin Kendall 09 Jan 1836 Wilkes Co, GA

WILKES COUNTY, GEORGIA, DEED BOOK MMM, p. 452

This indenture made this the ninth day of January in the year of our
Lord one thousand eight hundred and thirty-six between Garrett Oglesby
of the County and State aforesaid of the one part and Reubin Kendall
of the same place of the other part.

Witnesseth that the said Garrett Oglesby, for and in consideration of
the sum of two hundred and fifty dollars to him in hand paid at and
before the signing and delivery of these presents, the receipt whereof
is hereby acknowledged, have granted, bargained, sold and conveyed and
do, by these presents, grant, bargain, sell and convey unto the said
Reubin Kendall, his heirs and assigns, all that tract or parcel of land
lying in the County aforesaid adjoining lands of Augustus Binns,
Frederick Hoggle and others known as Oglesby's mill tract on Newford
Creek containing fifty acres, more or less, to have and to hold
said tract or parcel of land unto Reubin Kendall, his heirs and
assigns, together with all and singular the rights, members and
appurtenances thereof to the same in any manner belonging, to his and
their own proper use, benefit and behoof for us in fee simple.

And the said Garrett Oglesby, for himself, his heirs, executors and
administrators, the said bargained premises unto the said Reubin
Kendall, his heirs and assigns, will warrant and forever defend the
right and title thereof against themselves and against the claims of
all other persons whatsoever.

In witness whereof, the said Garrett Oglesby hath hereunto set his hand
and seal the day and year above written.

Personally came before me Reubin Saffold and being duly sworn deposeth
and saith that he saw Garrett Oglesby sign, seal and deliver the within
deed for the purposes therein mentioned and that the deponent
subscribed the same as a witness and that Thomas R. Thurmond do so like
