Indenture bet Garrett Oglesby & Wylie Hill 11 Dec 1843 Wilkes Co, GA WILKES COUNTY, GEORGIA, DEED BOOK PPP, p. 442 This indenture made the eleventh day of December in the year of out Lord one thousand eight hundred and forty-three between Garrett Oglesby, Senior, of the County and State aforesaid of the one part and Wylie Hill of the same place of the other part. Witnesseth that the said Garrett Oglesby, Senior, hath this day made and delivered to the said Wylie Hill his certain promissory note subscribed with his hand and bearing even date with these presents whereby the said Garrett Oglesby, Senior, hath promised to pay the said Wylie Hill or bearer three hundred and seventy-nine dollars (and) twenty-five cents on or before the twenty-fifth day of December, one thousand eight hundred and forty-four, for value received. Now, for and in consideration of the sum of five dollars to the said Wylie Hill to the said Garrett Oglesby, Senior, in hand paid, the receipt whereof is hereby acknowledged, as well as for the securing the payment of the aforesaid promissory note, the said Garrett Oglesby, Senior, hath granted, bargained and sold and doth, by these presents, grant, bargain and sell unto the said Wylie Hill, his heirs and assigns, a negro man by the name of Henry, said negro between twenty- five and thirty years of age. To have and to hold said negro man Henry to the said Wylie Hill, his heirs and assigns, to his and their own proper use, benefit and behoof forever. And the said Garrett Oglesby, Senior, for himself, his heirs, executors and administrators, the said bargained property unto the said Wylie Hill will warrant and forever defend against the claim of himself and his heirs and against the claim of all other person or persons whatsoever. Provided nonetheless that if the said Garrett Oglesby, Senior, his heirs, executors and administrators, shall and do well and truly pay or cause to be paid unto the said Wylie Hill, his heirs and assigns, the aforesaid sum of three hundred and seventy-nine dollars (and) twenty- five cents on the day and time mentioned and appointed for the payment thereof in the said promissory note mentioned according to the tenor of said note, then and from thenceforth on, will this present indenture and the right to the property thereby conveyed as the said promissory note shall cease, determine and be void to all intents and purposes.
