Indenture bet Joseph Oglesby & Frances Smith 20 Mar 1849 Wilkes Co, GA WILKES COUNTY, GEORGIA, DEED BOOK QQQ, p. 240 This indenture made and entered into this twentyeth day of March, 1849, between Joseph L. Oglesby, executor of Garrett Oglesby, and Frances E. Smith. Witnesseth that whereas on the first Tuesday in January, 1849, said executor did expose to public sale in pursuance of an order made at the September term, 1849, of Wilkes Superior Court by consent of all parties thereto the tract of land herein after named after duly and legally advertising the same for 30 days in which John Wilkerson's heirs are jointly concerned and when upon such advertising and sale Frances E. Smith was the highest and best bidder. Now for and in consideration of said bid, the same being the sum of one hundred and sixty-five dollars, to me in hand, I, the said Joseph L. Oglesby, executor as aforesaid, do hereby bargain, grant sell and convey unto (the) said Frances E. Smith, his heirs and assigns, all that tract of land situate(d), lying and bounding on Pope's Chapel Meetinghouse, the same jointly bought in their lifetime by John Wilkerson, deceased, and Garrett Oglesby and by which a one half part was sold also on the (first) Tuesday in January, 1849, by executors of Wilkerson and conveyed to Frances E. Smith. To have and to hold the same to him, his heirs and assigns forever, and I, the said Joseph L. Oglesby, executor as aforesaid, do covenant with the said Frances E. Smith that I am duly authorized to convey the said premises, that I have in all things observed the requirements of the law in said sale, and I, the said Joseph L. Oglesby, do further covenant to warrant and defend the same unto said Frances E. Smith, his heirs and assigns, against all persons claiming under said Garrett Oglesby or me.
