The execution of a writ of fiere facias is termed as a “Fi Fa.” Copied at the Wilkes County Courthouse in Washington, Georgia, September 2006, transcribed and [annotated] by Marshall Styles: State of Georgia} Wilkes County} This Indenture made this the 14 day of February A.D. Eighteen hundred and eighty two between John J. Crafton, Sheriff of the County aforesaid of the one part and M.M. Sims & Samuel H. Hyman(?) as partners under the _?_ name of M.M. Sims & Company of the County of Wilkes, State of Georgia of the other part. Witnesseth that whereas the said John J. Crafton sheriff as aforesaid did lately seize & levy upon a certain tract or piece of land, situate, lying & being in the County aforesaid and described as follows: to wit, one tract of land lying & being in the County & State aforesaid and bounded and adjoining lands of J.W. Hill, W.T. Harris and others & containing by estimation one hundred & sixty two acres more or less, and lived upon as the property of Jasper S. Tate, by virtue of two counts of fiere facias, issued from the Superior Court of Wilkes County, one a common law Fi Fa, and the other mortgage Fi Fa, binding the same tract or parcel of land against said Jasper S. Tate as maker in the common said fi fa, and W.T. Harris as endorser and Jasper S. Tate in Mortgage Fi Fa and after publicly advertising said tract or parcel of land agreeably to law, did put up & expose the same to sale at public outcry, on the first Tuesday in February A.D. Eighteen hundred and eighty two at the door of the Court House at Washington in said County between the legal hours of sale, when said tract or parcel of land was knocked off to said M.M. Sims & Co at and for the sum of Twenty five dollars, they being the highest and best bidder. Now for and in consideration of the sum of Twenty five dollars in hand paid to him the said john J. Crafton Sheriff, as aforesaid, by them the said M.M. Sims & Co at and before the sealing & delivery of these presents, the receipt whereof is hereby acknowledged, the said John J. Crafton sheriff, as aforesaid, hath granted, bargained & sold. . . unto them the said M.M. Sims & Co, their heirs, executors, administrators and assigns, all the right, title and interest of the said Jasper S. Tate in said tract or parcel of land. . . In Witness whereof the said john J. Crafton, Sheriff of the County aforesaid of the one part and M.M. Sims and Samuel H. Hyman(?) as parties under the firm name of M.M. Sims & Co of the County of Wilkes, State of Georgia of the other part. . . to wit, one tract or parcel of land lying and being in the State and County aforesaid and described as follows. . . bounded by and adjoining lands of T.W. Hill, James C. Wright and others containing by estimation seventy five acres more or less; also one house & lot in the Village of Mallorysville, County and State aforesaid, and containing eight acres more or less, and known as the Jordan lot, and being the same house and lot which W.T. Harris lives at the present time, the same was sold by the said John J. Crafton as sheriff, as the property of W.T. Harris by virtue of a writ of Fiere Facias, issued from the Superior Court of Wilkes County in favor of Bank of Washington, Georgia, located in the State and County aforesaid, against said Wm. T. Harris as maker and Benjamin F. Jordan as Endorser and after publicly advertising said tract & lot offered agreeably to law, did put up and expose the same to sale at public outcry on the first Tuesday in February A.D. Eighteen hundred and Eighty two at the door of the Court House at Washington in said County, within the legal hours of sale, when said tract & lot of lands was knocked off [sold] to said M.M. Sims and S.H. Hyman(?) under the firm name & style of M.M. Sims & Company at and for the sum of Three hundred 7 ninety dollars, they being the highest & best bidder. . . in fee simple. . .
