Copied at the Wilkes County Courthouse in Washington, Georgia, September 2006, transcribed and [annotated] by Marshall Styles: State of Georgia} County of Wilkes} This indenture made this 2nd day of April A.D. 1879. Witnesseth, that G. Toombs of said County and State, for and in consideration of natural love and affection, does by these presents give, grant and convey unto his Daughter Catherine Colley, wife of F.H. Colley, and to her children now born or to be born, all that tract or parcel of land lying and situate in said County & State, and commencing at Cedar Corner upon the public road leading from the Town of Washington to a point on Fishing Creek, commonly known as the Old French Mills, and running along said Road to Gregg and Thomas Andrew’s line, said land being more fully and specially described by metes and bounds on a plat of the same hereto annexed and made a part of this deed, and containing by estimation one hundred and sixty one acres, more or less. Said tract of land being the same sold and conveyed to the said G. Toombs by D.M. DuBose [father of Frances Camille DuBose who married Henry Owens Colley], President of the Bank of Washington Georgia by deed bearing date March 4th 1879 and recorded in the Clerks Office of Said County in Book 200.14, folio 214, 215 & 216. To have and to hold the above granted premise, together all the rights members and appurtenances thereto in anywise belonging to the said Catherine Colley and her children now born or to be born forever in Fee Simple. The said tract of land hereby conveyed is to be accounted for by the said Catherine Colley in the distribution of the Estate of said G. Toombs at Five hundred and twelve dollars. State of Georgia} County of Wilkes} In Consideration of Natural love and affection, I hereby give and convey to my Daughter Catherine Colley, wife of F.H. [Frank Harris] Colley, and her children now born and to be born forty two and one-half acres of land lying in said county on the French Mills Road, about three miles north east of Washington, and adjoining lands of R. Toombs [Gabriel’s brother Robert], the said French Mills Road, lands of the Estate of James M. Dyson, , and lands already conveyed by me to said Catherine Colley, by a deed bearing date April 2, 1879 – The 42-1/2 acres herein conveyed being a part of the land of Z.D. Colley [Zebulon Decatur Colley is the uncle of Frank Harris Colley] recently sold, and which is more _?_ described as follows: Commencing at a small cedar tree on the French Mills Road, and running in a south west direction with said road 5 chains to a stake, thence. . . to a stake on Dyson’s line thence . . . to the beginning corner. To have and to hold the above mentioned premises unto the said Catherine and her children, born and to be born, forever in Fee simple, The right and title to which I hereby warrant and will forever defend against the claim or claims of myself, my heirs, administrators and Executors. This is not intended by me as an advancement to my said daughter or her children, nor is she to account for the same in any manner whatsoever in the distribution of my estate.
