This file was contributed by: Barbara Walker Winge Barbarawinge@yahoo.com ==================================================================== State of Georgia )) Wilkes County )) In the name of God amen I Jacob Cain of State & County aforesaid being weak and low in health but of sound mind thanks be to god for it But calling to mind that it is appointed once for all men to die -- do make this my last Will and Testament in manner & form following (viz) first I commit & commend my Soul into the hands of Almighty God hoping for Salvation through the merits of Jesus Christ - My body to be buryed in a christian like manner. Item - I give & bequeath to my beloved Wife Elizabeth L. Cain the Tract of Lands to live on during her natural life - & then to be sold and equally divided between her five children - (viz) Jacob N. L. Cain - Hardy W. Cain - Caroline Cain - John M. Cain - and Miriam Matilda Ann Cain to be possessed & enjoyed by them & their heirs for ever - Item - I give & bequeath to my Wife Elizabeth L. Cain a negro boy named Dembo & a negro woman Dilcy to her & her heirs for ever - also all my Household & kitchen furniture horses Cattle & Hogs to be possessed & injoyed by her forever - Item - My will & desire is that the Tract of Land lying on Little River State & County aforesaid on which I formerly lived be sold on a credit of twelve months and the money arising thee from to be applyed to the Education of my five Children above named. Item - I give & bequeath to my five Children James B. Cain - Lucy W. Harrison, Sarah B. Cain - Elizabeth P. Miller - and Patsy S. Shearer - a Tract of Land lying in Wayne County on Satilla River containing four hundred & ninety acres to be equally divided between them - and to be possessed & injoyed by them & their heirs forever - Item - I give & bequeath to my five younger Children Jacob N. L. Cain - Hardy W. Cain - Caroline Cain - John M. Cain - and Miriam M. A. Cain - The remaining part of my negroes - (viz) Feraby, Lankesetter, Isabella, Anacaid, Sandy, Nathan, Martha, Vincent, and Ansel, to be possessed & injoyed by them & their heir forever - The said negroes to be hired out until my Son Jacob N. L. Cain becomes of age or marrys - the money arising from the hire of said negroes to be applyed to the maintenance of my five younger Children and at the time my Son Jacob N. L. Cain arrives to the age of Twenty one years or marrys then my Will and desire is that the above named negroes be equally divided between Jacob N. L. Cain - Hardy W. Cain - Caroline Cain - John M. Cain - and Miriam M. A. Cain - Item - My will & desire is that the money due me may be collected & may be applyed to the discharge of all my just debts - Lastly I do hereby appoint my beloved Wife my Executrix and Uarsha A. Martin my Executor of this my last will & Testament disannuling & revoking all others heretofore made by me - in witness whereof I have hereunto set my hand and seal this 23rd of February 1820. Gilmer who saith upon oath that he heard Jacob Cain duly acknowledge the above instrument to be his last will and testament, that this departed attested it at the time & said Ann L. Gilmer also attested that the same was done in the presence of the testators & that he was of sound and disposing mind & memory - - It was ordered by the Court that Applicant recorded of the _____ due to the lien of for her ___ in this behalf ordered & Respondents in Mercy this August 12, 1824 Duncan G.
