I Demsey C. Colley make this my Last Will & Testament revoking all other heretofore made, feeling that I am of sound & disposing mind & memory & it being necessary to make some disposition of the property with which a Kind Providence has blest me, Knowing the uncertainty of life. First, I desire that my body shall be buried in a decent & Christian like manner suited to my Condition & Circumstances. Secondly, I desire & direct that all my just debts be paid by my Executor hereafter named. Thirdly I desire that (& direct to be so) all my Estate after the payment of my just debts be thrown into my Father’s Estate & become part & parcel of the same & subject to his will & in case of his (my Father Francis Colley’s) death before my death then to go to my Mother Frances Colley according to my Father’s Will. Fourthly, I hereby constitute & appoint Zebulon D. Colley my Executor. October 21st 1861 {Signed} D.C. Colley [The second set of initials is so unreadable that a determination of it is not possible] Additional Comments: Anticipating that he might not return home alive from fighting the Yankees, Dempsey Carroll Colley wrote his Last Will and Testament in Wilkes County, Georgia, on 21 October 1861. Dempsey Carroll Colley is son of Francis Colley & Frances Owens. He was killed on 13 December 1862 at Fredericksburg Virginia.
