She is daughter of Henry France, and widow of John Colley, Deceased. Sarah’s son-in-law, Kirby Goolsby, the husband of Nancy Colley, appoints Adam Ragland as attorney-in-fact to deal with his brother-in-law, Francis Colley, to recover “my distributive share” of the estates of John Colley and wife Sarah France Colley. This appears to have been necessary as Kirby and wife Nancy were apparently at this time residents of Meriwether County, Georgia. The power of attorney is, at times, rather confusing in its intent and wording. It is also unclear as to why no mention is made of Nancy. Copied at the Wilkes County Courthouse in Washington, Georgia, September 2006, transcribed by Marshall Styles: Georgia} Wilkes County} Know all men by these presents that I Kirby Goolsby for divers good causes & consideration ___?___ have made ordained and appointed by these presents doth make ordain and appoint Adam Ragland of the County and State aforesaid my true & lawful attorney for me and in my name to ask, demand, sue for recovery and receive from Francis Colley Executor of the Last Will and Testament of John Colley dec’d late of the County of Wilkes and State aforesaid all of my distributive share as a legatee of the Said John and all such sums of money as may be due to me from the Estate of the Said John and also to ask, demand, sue for recovery and received from the Said Francis Colley administrator of Sarah Colley deceased all my distributive share of the Estate of the said Sarah as one of the heirs and distributes and all such sums of money as may be due to me from the Estate of the Said Sarah, and to have use and to take and to take all lawful means in my name to receive and recover the same and acquittantances(?) or _?_ sufficient receipts and discharges for the same for me and in my name to make, seal and deliver and to do all other lawful acts and things whatsoever concerning the collection and receipt of said legacy and distributive share of money, as fully in every respect as I myself might or could do as even I personally present at the doing thereof verifying and confirming and by these presents allowing whatsoever my said Attorney shall in my name lawfully do or cause to be done in and about the premises by virtue of these presents. In witness whereof I have hereunto set my hand and affixed my seal being the ninth day of September in the year eighteen hundred and thirty six (9th Sept 1836) Kirby Goolsby {Seal} Signed Sealed & Delivered in presence of William R. Ector, JJC Recorded November 17th 1836 Received of Francis Colley Executor of the Estate of John Colley Deceased the sum of nineteen hundred and Sixty Eight Dollars & Sixty five cents in full for the Distributive Share of Kirby Goolsby in the Estate of Said John Colley Deceased both real & personal and the said Kirby Goolsby his proportionable part of all Debts demands or dues that may come against said Estate and be recovered of Said Executor the above amount received by me & the bond given by virtue of the within Power of Attorney.
