Copied at the Wilkes County Courthouse in Washington, Georgia, September 2006, transcribed and [annotated] by Marshall Styles: State of Georgia} Wilkes County} This Indenture made this tenth day of February in the Year Eighteen hundred and thirty seven Between Francis Colley Executor of John Colley deceased of the one part & Welcome Fanning [son-in-law of John Colley] of the other part, both of said County & State Witnesseth that the said Francis Colley did advertise by public advertisement to sell the real estate of said John Colley deceased and whereas the said Colley Executor as aforesaid did in conformity to said advertisement expose at public sale the tract of land and premises hereinafter described on the first Tuesday in March 1834 at the Court House in said County when & where said Fanning became the purchaser at and for the price or sum of twenty seven hundred & fifty one dollars, him being the highest and last bid obtained. Now for and in consideration of the said sum of twenty seven hundred and fifty one dollars to me in hand paid by the said Fanning at and before the sealing & delivery of these presents, the receipt whereof is hereby acknowledged have granted bargained & sold and by these presents doth grant bargain sell & convey unto the said Fanning his heirs and assigns all that tract or parcel of land situate lying and being in said State & County on the waters of Fishing Creek & Beaverdam Creek adjoining Henry France [a relative, perhaps of Sarah France Colley, widow of John Colley], Nicholas Wylie, Parker Callaway & Alexander Pope containing eight hundred and twenty six and one half acres, be the same more or less being the same tract or parcel of land formerly owned by said Colley deceased & whereon he lived at the time of his death part of which was granted to the heirs of Simon Autrey deceased as will appear by the grant for the same for three hundred acres and the balance conveyed by Will Terrell, Thos. Reynolds & Thomas Hughes, Lucius Barrett & John Crutchfield, Asa Hanks & Wife, Margaret Smith, Joseph Smith, Thomas Smith & William Smith to said John Colley deceased by deeds recorded in the Clerks Office of the Superior Court of said County of Wilkes by reference to which grant & deed the courses, distances, corners etc to said tract or parcel of land will fully appear. Together with all and singular the rights members and appurtenances to the said tract or parcel of land being belonging or in any way appertaining – To have and to hold the said tract or land & premises to the said Welcome Fanning his heirs and assigns forever. And I the said Francis Colley executor as aforesaid the tract of land aforesaid and all singular the rights members and appurtenances to the same belonging or in any way appertaining, will warrant & forever defend unto the said Welcome Fanning, his heirs & assigns against the claims of myself my heirs & assigns and against the claims of all other persons whatsoever as far as the law authorizes me as Executor as aforesaid & no further.
