This file was contributed by: Gwen Cosby Moore & Linda Cosby gfm1012@aol.com ==================================================================== Hickerson Cosby Will Registered 8th Jan 1807 I Hickerson Cosby of the County of Wilkes and State of Georgia being in a low state of health but of a sound and disposing mind and memory do make and ordain this my last will and testament in manner and form following to wit (first word illegible) Whearas I have purchased a tract of land in the County of Columbia of John North and made a partial payment for the same, my will and desire is that my Executors shall sell my Negro woman Eve at private sale or otherwise as they may think proper for the purpose of making payment for said land and in case she should not sell for a sufficency to make payment by the time my bond becomes due together with what they may be able to collect it is my desire that my Executors shall sell such other of my property as they and my wife shall be of opinion can be best spared to compleat the full payment for the said tract of land Item It is my will and desire that after all my just debts are paid that the ballance of my estate shall be kept together for the purpose of supporting my wife and children Never the less it is my desire that in case any of my children marrying that if my Wife and Executors shall be of opinion that any of the property can be spared from the support of my family that in that case my Executors may let such child or children have part of my estate as can be spared not exceeding what may be supposed to be their share after the death of my wife Item It is my will and desire that after the death of my wife that all my estate both real and personal shall be equally divided between my Children and their Heirs I do hearby nominate Constitute and appoint my friends John Wingfield, Robert Harris (this is actually Hickerson's wife's brother)and Peter B.(possibly D) Terrell and my son Garland Cosby Executors of this my last will and testament - In testimony whereof I have here unto set my hand and seal this 19th day of July 1805 Signed Sealed & Acknowledged Hicks Cosby (Seal) In the precence of P d Terrell Sanders Stallings Georgia Columbia County Sanders Stallings one of the subscribing witnesses to the (illegible) intrument of writing after being sworn on the Gospel of the Almighty God saith that he saw Hickerson Cosby in his lifetime subscribe his name to the written instrument as his last will and testament as a witness thereto and that he saw David Terrell present subscribe as a withness thereto and that the testator was of sound mind and disposing memory Sworn to Suscribe Sanders Stallings in Open Court this 5th Jan 1807 A Crawford Clk
