I, MILES DUNCAN of Wilkes County, State of Georgia being weak and infirm in Body but perfect in mind and memory Do make and Constitute this as my last will and testament. First I desire that the Expences attending my Death and funeral be Discharged also all debts of what nature soever be Duly and honestly paid. Then the remainder of my Estate real and personal viz. 60 Acres of Land situate and lying on Kettle Creek adjoining lands of John Cargel, John Edwards & David Duncan, a Negroe boy named Will about Seven years of age, a horse (now astray) if found, Eleven Head of Cattle, seven Head of Hogs, together with two notes of [land? or hand?] on James Ware of Ogegee[?] County and state afsd. For three thousand five Hundred Wt. of Tobacco each, also all my household furniture I give and bequeath to my loving wife Ann to have hold and Enjoy the same for the use and purpose of supporting herself and Children. I further constitute and appoint John Ogletree of county and state afsd to act in conjunction with my wife Ann as exctrs of this my Last [will] and Testament. And I do hereby revoke disallow and utterly ( ) all former Bequests Wills and Legacies by me heretofore in any wise left or made Declaring ratyfying and confirming this and no other to be my last will and Testament. In Witness whereof I have hereunto set my Hand and Seal this thirtieth Day of August One Thousand Seven Hundred and Eight nine. /s/ Miles Duncan Signed Sealed and Declared by the Within named testator Miles Duncan to Be his last will and testament in the presence Of us who subscribed our names in the Presence of sd. Testator and of each other. /s/ David Duncan /s/ Isaiah Phillips /s/ Sarah (her mark) Duncan State of Georgia, Wilkes County Appeared before me the eighteenth day of April in the year of our Lord One Thousand seven hundred and ninety one David Duncan of the said County being one of the subscribing Witnesses to the within Will by me being duly sworn on the Holy Evangelists of Almighty God doth depose and say that he saw the within mentioned Miles Duncan the Testator sign, seal, publish and declare the within instrument to be his last Will and Testament and that at the time of his doing the same he was of sound disposing mind memory and understanding to the best of his knowledge and that he with Isaiah Phillips and Sarah Duncan at the Testators request in his presence and in the presence of each other subscribed their names as Witnesses to the same.
