His son Bryan Fanning Administrator is the grantee. Copied at the Wilkes County Courthouse in Washington, Georgia, September 2006, transcribed and [annotated] by Marshall Styles: State of Georgia} Wilkes County} This Indenture made the 23rd day of December in the year of our Lord One thousand Eight hundred & Seventy four, between F.H. [Frank Harris] Colley of said county of the first part and Bryan Fanning Administrator of Welcome Fanning of the same place of the second part. Witnesseth, that the said party of the first part, for and in consideration of the sum of One thousand Dollars to him in hand well & truly paid by the said party of the second part, at and before the sealing & delivering of these presents the receipt whereof is hereby acknowledged, has granted, bargained, sold, delivered, conveyed and confirmed. . . unto the said party of the second part. . . all that tract of land lying & situate in said county on the waters of Fishing Creek adjoining lands of Robert Bunch, Lane Anthony & containing one hundred and fifty acres, more or less. Also, his interest in the Colley place [Franks’s deceased father Henry Francis Colley’s place?], lying & situate on Little River in said county adjoining lands of Hill, Moore, & Adams, & bounded by Little River amounting to one hundred & fifty acres, more or less. . . To have and to hold the said tract or parcel of land and all and singular the premises and appurtenances. . . [Frank Harris] Colley of a tract of land lying on Fishing Creek containing one hundred and fifty acres more or less & an interest in a tract of land lying on Little River back in said county, the latter tract containing twelve hundred acres more or less, the same having been deeded & conveyed to me as Security, Reconveying said lands to the said F.H. May Term 1881, Wilkes Superior Court Friday May 6th 1881 Cozart Binns & Company} Vs} Bryan Fanning, Administrator &} Webster Fanning} We the Jury – to Wit: 1 John T. Keough. 2 W.H. Scott. 3 William Maxwell. 4 C.R. Strozier. 5 Samuel W. Shepherd. 6 F.W. Kendrick. 7 William M. Hill. 8 William R. Echols. 9 L.M. Hill, Jr. 10 John E. Heard. 11 Dudley Jones. 12 Rufus Z. Gresham, find and decree that the Bond for Titles made by Bryan Fanning Administrator to Webster Fanning on 7th May 1878 conditioned to make titles to all that tract of land in Wilkes County, bounded by lands of Preston Harden, A.H. Cason, T.J. Beck and others containing Five hundred and Sixty three acres be and the same is hereby corrected so as to incorporate in the same as the promissory note therein referred to, the said note a copy of which is annexed to said Bill as Exhibit “B”; We further find and decree that the said Bryan Fanning as such Administrator do make a Deed to the said land above described to said Cozart Binns & Company to _?_ of said bond, they having fully complied with the conditions of said Bond as to payment of said note. {Signed} Wm. Maxwell Foreman Whereupon it is decreed that the verdict of the jury in the case be confirmed, and that the Bond for titles be reformed as specified in the verdict, and that said Bryan Fanning Administrator do make a deed to said land as provided in said verdict, and that defendant Bryan Fanning pay the costs. {Signed} E.H.
