Couthouse) Wilkes Co., GA Will Book HH, page 98 WILL OF JOHN OGLETREE In the name of God Amen I JOHN OGLETREE of Wilkes County and State of Georgia being of sound mind and memory thanks be to God calling unto mind the mortality of my body and knowing that it is appointed for all men to die, do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul to God that gave it to me and I my body I recommend to the earth to be buried in a Christian manner at the discretion of my executors, and as touching such worldly estate wherewith it has pleased God to bless me in this life I dispose of the same in the following manner. Item1st I give UNTO MY BELOVED WIFE PIETY the one third of the plantation I live on together with the houses thereon likewise one Negro man named Peter also one third of the horses, cows, hogs, sheep, geese and fowls, also one third of the beds and furniture, also one third of the kitchen furniture, also one saddle and bridle during widowhood. Item 2nd I give unto MY SON EDMOND OGLETREE AND PATSY HIS WIFE, one third of the said plantation and on the death of his mother the one half of the land she was possessed of by virtue of this will, also one half of all her legacy, also one Negro man named Joe also one third part of the horses, cows, hogs, sheep, geese and fowls, also, one third of the kitchen furniture, also one third of the beds and furniture. Item 3rd I give UNTO JAMES HACKNEY, AND PATSY BRANTLEY, HIS WIFE the other part of the plantation I now live on and on the death or marriage of my wife the one half of the land she was possessed of by virtue of this will, also one Negro woman named Nance and her child named Amanda, also one third of the horses, cows, hogs, sheep, geese and fowls, also one third of the beds and furniture, also one third of the kitchen furniture, also at the death of marriage of my wife it is my will that one half of all the property I leave her shall belong to James Hackney and his wife Patsy. Item 4th I give UNTO CHESLEY RAY five dollars for legacy. Item 5th I give UNTO THE CHILDREN OF CHESLEY RAY the plantation whereon he now lives. Item 6th I give UNTO MY SON WYLIE OGLETREE the sum of five dollars. I lend TO HIS WIFE NANCY OGLETREE for her use one hundred dollars. Item 7th I give TO RICHARD OGLETREE SON OF WILEY OGLETREE the sum of fifty dollars to him and his heirs forever. Item 8th I give to MY SON WILEYS DAUGHTER SUSANNAH RICKASON fifty dollars to her and her heirs forever. Item 9th I give to MY SON DAVID OGLETREE two hundred dollars to him and his heirs forever. Item 10th I give TO MY [SON] ABSALOM OGLETREE five dollars also to son Absalom’s children that plantation whereon Absalom now lives to be their own forever. Item 11th I give UNTO MY SON DECEASED CHILD NANCY one hundred dollars ALSO TO BENJAMIN AND JOSEPH fifty dollars each. Item 12th It is my will that my wagon and blacksmith tools should be sold likewise the residue of my negroes that is Nan, Proc, Eleck, Rachel and her children the balance of the money arising from the sale of the negroes and other articles above mentioned is to be equally divided amongst WILLIAM AND LITTLETON OGLETREE AND NANCY OGLETREE’S CHILDREN SO THAT NANCY RAY’S CHILDREN draw one fourth part, ABSALOM OGLETREE’S CHILDREN one fourth part and WILLIAM AND LITTLETON OGLETREE the other two fourths. Legerts appointed by the honorable Inferior Court when setting for ordinary purposes to divid the Estate of John Ogletree, Sr., agreeable to the will having proceeded and don the same as follows. For Piety Ogletree, Wd., one third of the plantation together with the houses, one negro man named Peter, one third of the horses, cows, hogs, sheep, geeze & fowl. Also one third of the beds & furniture. Also one saddle & bridle during her widowhood. Cash forty five dollars and 10˘ her part of surplus money. For Edmund Ogletree one third of said plantation and at the death or marriage of his mother, one half of the land she is possessed of by virtue of this will. For the children of Chesley Ray the plantation where he now lives. For Wiley Ogletree five dollars as special legacy and forty five dollars 10˘ part of surplus. For Nancy Ogletree one hundred dollars to and for her use for her life time. For Richard Ogletree son of Wylie fifty dollars special legacy. For Susanna Rickerson daughter of Wiley Ogletree fifty dollars as special legacy. For David Ogletree, dec’d two hundred dollars special legacy, also forty five dollars 10˘ his share of surplus. For Absalom Ogletree five dollars special legacy, also forty five dollars 10˘ his part of surplus.
