His widow, Mary (Nash) Montgomery was appointed admrx. of his estate. The following transcription was made from a poor copy of the original Letter of Administration, hence, omissions and "best guesses" of wording occur in the document. Wilkes County, Georgia, Book QQ (Page) 157/ Georgia Know all men by these that we Mary Montgomery James Robertson Jesse Partridge are held and Firmly bound unto David Terrell Register of Probates for said County and his successor in Office in the sum of five thousand Dollars for the payment for the payment (sic) of which sum to the said Register of Probates and his successors in office we bind ourselves our Heirs, Executors and Administrators jointly & severally firmly by these presents sealed with our Seals and dated this 28th day of May 1796. The Condition of the above Obligation is such that the above bound Mary Mountgomery administrator of the Goods, Chattels & Credits of David Mountgomery late of said County deceased, do make a true and perfect Inventory of all and Singular the Goods Chattels and Credits of the said deceased which have or shall come to the hands or possession of the said Mary Mountgomery or into the hands or possession of any other person or persons for them & the same do exhibit into the said Court of Wilkes whereof they shall be thereunto required and such Goods Chattels and Credits do well and truly administer according to Law, and do make a true and just account of her acting and doing therein when required by the Superior Court or Register of Probates for said County and all the rest of the Goods (Page) 158/ Chattels and Credits which shall be found remaining upon the account of the said Administrator the same being first allowed of by the said Court shall deliver & pay to such person or persons respectively as are entitled to the same by law, and if it shall hereafter appear that any Last Will and Testament was made by the said deceased, and the same be proved before the Court and the Executors Obtain a Certificate of the Probates thereof and the said Mary Mountgomery do in such case if required render and deliver up the said Letters of Administration then this Obligation to be Void otherwise to remain in full fource (sic) and Virtue.
