Will of Mary Montgomery, 3 Jan 1838, 7 May 1838 Wilkes County, GA Will Book 11, 1837-1837, page 20. I Mary Montgomery of the County of Wilkes and State of Georgia being in perfect mind and memory knowing the fraility of mankind do make and appoint this my last Will and Testament that is to say Item 1st I wish all my just debts punctually paid. Item 2 I give to my daughter Elizabeth Robinson One Sixth Part of my Estate, after paying to Martha Smith, Susannah Shahan & Joseph White the sum of thirty seven dollars it being the amount of two notes of hand given by James Robertson dated January 27th 1827 payable twelve months after date. Item 3 I give and bequeath unto David Montgomery Sr. One Sixth Part of my estate. Item 4 I give and bequeath unto Nancy Montgomery and her children One Sixth Part of my Estate. Item 5 I give and bequeath unto Elizabeth Lee daughter of Daniel Arnold One Sixth Part of my Estate. Item 6 I give and bequeath unto Mary Magahee One Sixth Part of my Estate. Item 7 I give unto Sarah White Daughter of James White One Sixth Part of my Estate. Item 8 I make and appoint William Samson and William Slaton my lawful Executors to this my last Will and Testament. – Signed and sealed in the dated this third day of January 1838. Hackney one of the subscribing witnesses to the within will who being sworn says he saw the test---? Mary Montgomery sign and seal and (---?) her acknowledge the same to be her last will and testament and at the time of her so doing she was of sound desposing mind and memory and that he signed the same as a witness in her presence and at her request together with Francis Slaton.
