Documents regarding Garrett Oglesby Estate 1846-1851 Wilkes Co, GA In re Disposition of Estate of Garrett Oglesby Wilkes County Court of Ordinary Minutes, 1839-1846 p. 330 - 6 Jul., 1846 It appearing to the Court that the usual notice has been given, it is ordered that Joseph L. Oglesby, executor of Garrett Oglesby, deceased, do proceed to sell eight negroes and the real estate of Garrett Oglesby, dec'd., first advertising as the law directs. p. 349 - 1 Mar., 1847 It being made (to) appear to the satisfaction of the Court that Joseph L. Oglesby, executor of the estate of Garrett Oglesby, dec'd., is in insolvent circumstances and that said estate is likely to be wasted by the improper conduct of said executor, it is therefore ordered that said executor give bond with approved security for the faithful execution of the trust reposed in him by said will and, in case of failure to comply with the above, this court will grant letters of administration with the will annexed to such person as shall be entitled to the same by law. Further ordered that a copy of this order be served personally on said Joseph L. Oglesby at least twenty days before the next term of this Court, or published once a week for four months prior to the next term of this Court in some public gazette of this state. p. 351 - 3 May, 1847 Upon application of Joseph L. Oglesby, executor of Garrett Oglesby, dec'd., ordered that said executor have leave to sell the remaining negroes belonging to the estate of Garrett Oglesby, due notice for leave having been given, he first advertising as the law directs. *N* Wilkes County Inferior Court Minutes & Other Records, 1842-1866 p. 108 - 1 May, 1848 J. J. McCalister } vs. } Sci. Fa. Shaler Oglesby Bail } It appearing to the Court that the within "Scuri Facus" has been duly served and that said Shaler Oglesby, the Bail, has not in any way complied with the condition of his said bail bond, as the writ return? that the body of Joseph L. Oglesby cannot be found and that no sufficient reason is offered by said Shaler H. Oglesby why judgement should not be entered up against him. It is ordered that judgement be and is hereby enterred up against said Shaler Oglesby for the amount of the judgement, principal, interest, and cost against Joseph L. Oglesby, to wit, the sum of $30.87 cents principal with interest from the 25th Dec., 1844, and the cost $16.25 cts. and also the cost of this proceeding. *N* Wilkes County Court of Ordinary Minutes, 5 Jul., 1847 - 23 May, 1855 p. 82 - May Term, 1850 On motion of Samuel Barnett as attorney for J. & S. Bones, a creditor of the late Garrett Oglesby, deceased, showing to the Court that Joseph L. Oglesby, executor of the last will and testament of said deceased, has failed to make regular returns of his administration of the estate of said deceased and also that the said Joseph L. is insolvent and likely to waste and mismanage said estate, it is ordered by the Court that the said Joseph L., executor as aforesaid, do appear at the next term of this Court, after service of this notice in manner pointed out by law, to show cause why he should not give security for the faithful administration of said estate or be discharged therefrom and letters de bonis non granted. p. 101 - January Term, 1851 Upon application of William M. Reese for the creditors of Garrett Oglesby, deceased, representing that Joseph L. Oglesby, executor of said Garrett, has failed to make returns to this Court of his actings and doings as such executor and has removed without the limits of the state of Georgia taking with him property of the estate of said Garrett and failed to do and perform the duties devolving on him as executor, it is ordered by the Court that the said Joseph L. Oglesby be and appear at the next term of this Court and show cause if any he can why his letters testamentary should not be revoked and it is further ordered by the Court that a copy of this also be served on said Joseph L. Oglesby ten days before the next term of this Court or that he be served by publication thereof once a week for three weeks in the Washington Gazette. p. 105 - March Term, 1851 Upon the application of William M. Reese for the creditors of Garrett Oglesby, deceased, referring to a rule nisi obtained at the last term of this Court and showing that the same has been duly served and the facts therein stated being shown to the Court, ordered that the letters testamentary granted by this Court to Joseph L.
