(Wilkes County, Georgia Will Book 10, pages 381-382) ------------------------------------------------------------------------ State of Georgia Wilkes County I, William N. Powell, of Said State and County, being of sound and disposing mind and memory, do make this my last will and testament: Item 1: I desire all my just debts may be paid as early as is consistent with the welfare of my estate. Item 2: I give and bequeath to my son, WILLIAM T. POWELL, all of the eastern side of my farm, in said State and County, to be cut off by a straight line commencing at a double willow at the corner of J.M. BOOKER's land, made by a junction of the line between his place and mine with the branch which is one of the boundaries between said BOOKER's land and mine and running in a straight line to a corner marked by a stake or a Black Jack between A.S. ANDERSON's land and my said farm. Item 3: I also bequeath to my said son all the stock and personally I may own and use on said part bequeathed to him, held by me at my death. Also, all debts, notes, and accounts which the tenants on said land, so bequeathed may be due me at the time of my death. He is to assume any debts due on said portion devised to him for which I may be bound. Item 4: All the balance of my said land and farm consisting of the western side of the same and cut off and bound by said line from said double willow to said stake or Black Jack, I bequeath to my wife, ANNIE S. POWELL, and my daughter, ETHEL LEONORA POWELL. There is to go with this, all furniture, lie stock corn crops, and all other personal property belonging to me on said place at the time of my death. Also all debts, notes and accounts due me by any tenants of mine on said part so devised to my wife and daughter. They are to assume and pay all debts I may be due at my death relating to the part of my farm bequeathed to them. Item 5: I do notbequeath or will anything to my son, ALBERT. N. POWELL. I have already bestowed on him considerable sums of money for a man of my means. His habits and life have been irregular and I am fearful if I should leave him anything it would be absored by his debts already made or dissipated. Item 5[sic: 6] I nominate WILLIAM T. POWELL and ETHEL LEONORA POWELL as the Executors of this my will and absolve them from all liability to give bond or to make any returns to any Court as to their actings and doings in this behalf. I also authorize them to make sales of my property, when necessary, fully as they deem best, without any order of Court. This the 14th day of January 1913. W.N. GILBERT, named as a witness to the within writing, purporting to be W.N. POWELL's last will and being duly sworn, saith, that he with M.A. POPE and ADDIE FANNING at the request of W.N. POWELL and in his presence and in the presence of each other, did attest as witnesses the within writing as W.N. POWELL's last will, that the same was signed and published by him in their presence as his last will, that he was at the time of said attestation and, signing by him, of sound and disposing mind, and memory, that he executed the within paper voluntarily.
