Her parents were Francis Powell, Rev. War Vet., and Nancy Whitehead. The Elizabeth Burdett mentioned below is her sister. Mary is also the sister of Nelson Powell, who died in Wilkes County in 1825, and of Benjamin Powell, who married Mary Burdett in Wilkes County in 1824.] Georgia } Wilkes County } } In the name of God Amen, I Mary Powell of said county and State being sick and weak in body but of sound and disposing mind and memory, knowing it is appointed for all to die do make publish and declare the following to be my last will and testament. Item 1st I will that all my just debts be paid, Item 2d I give and bequeath unto my nephew Virgil E. Burdett, my negro boy Charles to him and his heirs, Item 3d I give and bequeath unto Elizabeth Burdett--wife of Joseph T. Burdett during her life or widowhood my tract of land in Wilkes County, adjoining Talbot and others which land is to be paid for out of my Estate all of my negroes and other property owned or possessed by me at my death. The same not to be subject to any Debt or contract of her husband and after her death to be Equally divided among all the children of said JOseph T. and Elizabeth Burdett share and share alike and in case of the death of said Joseph T. Burdett and his wife again marrying a Division of the property then to take place and she the said Elizabeth to renew as child's part and in case of the death of the said Elizabeth and the said Joseph T. again marrying, the property then to be divided and be to renew a child's part, And lastly I do hereby nominate constitute and appoint my friends Augustine C. McMekin and John H. Dyson Executors to this my last will and testament hereby annulling all Wills heretofore made by me, ___ the word all intended before signing.
