Fountain STATE OF GEORGIA, WILKINSON COUNTY I, James H. Fountain, of the County of Wilkinson, being in health and sound mind, and mindful of the uncertainty of life do make and publish this my last will and testament. First. I desire and give unto my wife Bethleland, as long as she shall continue a Widow, a lot of land 233 in the 26th, District of Wilkinson County, the place where I now live and containing 202½ acres of land. Also I give and bequeath to my beloved wife, the followering Negroes, to-wit: Negro man Henry, Negro woman Charlotte and $200 in money. All this property to hold during her widowhood, except that the boy Henry to hold her lifetime; and after her death to be returned to my Children and equally divided among my children. ITEM TWO. I give unto my son Augustus’ children the following Negroes and land. 170 acres of land in the Fifth District No. 109 of Wilkinson County; also I bequeath and give him two Negroes and their issue: Caroline and Georgian, also I give to children $200 For their schooling. ITEM THIRD. I give unto my son John’s children, one lot of land, No. 90 in the Fifth District of Wilkinson County, containing 202½ acres of land. I also give him two Negroes, Permelia and Margiann. I also give him $75 each for schooling. ITEM FOURTH. I give to my daughter, Sara Ann Ward, 100 acres of land in the 26th, District of Wilkinson County, No. 207. I also give her Anne, a Negro girl and her issue. This property to not be subject to any debts of her husband and now nor here-after; and To remain in the trust by my Executors for the heirs of her body. ITEM FIFTH. I give unto my three daughters, Epsey, Lucy Ann, and Nancy Caroline, Each of them in trust, not subject to any debt of their husband, and for them during their natural life, one full or equal share of my property which is not willed to any of my heirs, and after their death to be divided among their bodily heirs, and should either of them die heir-less, the property to go to my five youngest children. ITEM SIX. I give unto my sons, Jackson I. Fountain, Seaborn Thomas Fountain Franklin and William T. Fountain, and their heirs, an equal share of my property not Otherwise willed. ITEM SEVENTH. I give unto my son, Benjamin, $100 in consequences of conduct Towards me. ITEM EIGHT. As I have made several advances in money and Negroes and property, I keep a book in my own handwriting for the purpose of recording all such amounts which I wish to be deducted from their portion of my estate. I also request that all of my just debts be paid out of my estate. I hereby constitute and appoint sons William T. Fountain and Jackson I. Fountain and Richard E. Hatfield, Executors of this my last will. In witness whereof, I have hereunto Set my hand and seal this 19th, day of March 1864. James H. Fountain, it should read Seaborn Fountain, Thomas Franklin Fountain, And William T. Fountain, Seaborn’s name was Seaborn Jones Fountain per family Bible and Tombstone.
