Roche Wednesday ruled that the estate of Johann Carl Pflueger must pay the government a total of $138,486, ending one of the final chapters in a 17 year old law suit. Judge Roche rendered a summary decision, so-called because the facts were agreed upon, against Henry H. Pflueger and Henriette Pflueger, the latter executrix of the estate. The sum involves $79,289 interest accumulated since 1932 on a principal of $59,197. Henry and Johann Pflueger were brothers born in Hawaii to J. C. Pflueger, who amassed a fortune in the islands under the reign of King Kalakaua. Henry was born in 1859 and Johann in 1861. (J. C. Pflueger was a big stockholder in the H. Hackfeld Co., Ltd., which eventually became a part of American Factors, Ltd. He also was one time consul general for Germany here. Henry moved to Prussia Johann Pflueger came to San Francisco to live, but his brother took up residence in Prussia and became a citizen of that nation, which pre-dated the German kingdom. When World War I came, Henry Pflueger’s property in the United States was seized by the U.S. government’s alien property custodian. Mr. Pflueger reclaimed his property in 1927, but the government withheld 20 per cent of it under seizure law. Subsequently Johann Pflueger was given power of attorney to recover the 20 per cent, and upon claiming his brother was a U.S. citizen the government paid over. Recovery was sought But in 1932 the government sued to recover the 20 per cent, alleging that Henry Pflueger was a German citizen. The decision Wednesday was the result of all parties agreeing Henry Pflueger had been a German citizen. Henry Pflueger died in 1947. He was a professor at the University of Bonn at the time of his death. There is some litigation still pending in Hawaii as the result of the case, and another case (Pflueger vs. Bazelon) is pending in Washington. Funds impounded in Washington will be used to pay the judgment rendered in San Francisco.
