Vernon, Iowa: You and each of you are hereby notified that there is now on file in the office of the Clerk of the District Court of Iowa in and for Bremer County, Iowa, the petition of C. H. Hastings, executor of the estate of Caroline A. Miller, deceased, asking that he be authorized to sell the following described real estate in Bremer County, Iowa. to-wit: Lots five (5) and six (6) in Block seven (7), J. J. Smith’s Addition to Waverly, Iowa.. The South half of Lots three (3) and four (4) in Block seven (7), J. J. Smith’s Addition to Waverly, Iowa. An undivided one-half interest in and to Lots five (5), six (6) seven (7) and eight (8) in block twenty-nine (29) Harmon & Le Valley’s Addition to Waverly, Iowa. An undivided one-half interest in and to Lot No. two (2) in Fractional Block No. One (1), Waverly, Iowa, as platted by W. P. Harmon. An undivided one-half interest in and to Lots sixteen (16) and seventeen (17) in Fractional Block five (5) in Harmon & LeValley’s Addition to Waverly, Iowa. An undivided one-fourth interest in and to Lots three (3) four (4) and five (5) in Fractional Block five (5) in Harmon & Le Valley’s Addition to Waverly, Iowa. An undivided one-half interest in and to the following described real estate: Commencing twenty (20) rods north of the Northwest corner of the Southwest quarter of the Northeast quarter of Section Nine (9), Township Ninety-two (92) North, Range fourteen (14) west of the 5th P.M. thence North twenty (20) rods, thence West thirteen (13) and 50/100 chains to center of river, thence down center of river nearly South Twenty (20) rods, thence East Fourteen and 52/100 chains to the place of beginning, containing seven (7) acres more or less. An undivided one-half interest in and to the following: Beginning at the Southwest corner, Section 35, Township 92 North, Range 14, thence north 10 chains, thence east 5 chains to Cedar River, thence south 10 chains, thence west 5 chains to beginning, except the following: Commencing at the southwest corner of the southeast quarter of the southwest quarter of said Section 35, Township 92, Range 14, thence running East 5 chains, thence north to a point on a line that would be a direct continuation east of the south line of the alley in Block Eight (8) John J. Smith’s Addition to Waverly, Iowa, thence west on said line 5 chains south to beginning. For the payment of legacies in the will of said Caroline A. Miller, deceased. The will of said decedent which gives said executor authority to sell said real estate, reads as follow: “And in order to enable my executor to administer my estate and pay the legacies herein, special power and authority is hereby given my executor to sell and dispose of any and all real and personal property of which I may died seized, at a price not less than the appraised value thereof.” An you are further notified that unless you appear thereto and defend on or before noon of the second day of the next term of the District Court to be begun and holden at the Court House in Waverly, Iowa, commencing on the 16th day of September, 1918, you will be considered to be in default and the prayer of said petition will be granted.
