J. Holmes Clerk of the District Court of the__, a court of record in and for the county and State, aforesaid Mary Gearhart, aged 77 (or 79) years, a resident of Fulton, county of Jackson State of Iowa, who, being duly sworn according to law, declares that she is the widow of Daniel Gearhart, who served the full period of sixty days in the Military service of the United States in the war of 1812; and who was the identical Daniel Gearhart who, was drafted in Captain Jacob Homel at Northumberland, Northumberland Co., Penn or about 15th day of September 1814 and was honorably discharged at Philadelphia, Penn on the 22nd day of December, 1814; that When my husband was drafted he resided at Northumberland Village, Northumberland Co., PA said soldier was a private when he was drafted he went to Philadelphia he then went to Marcus hook on the Delaware and remained there a month or two and from there was called back to Philadelphia and discharged. My husband recd 40 acres of land for said service first and then afterwards one hundred and twenty, at time he left discharge at the office of Commissioner of Land, Washington D.C. that she was married under the name of Mary Gearhart to said Daniel Gearhart on the 22nd day of October 1813 by Mr. Norberry a Justice of the Peace at Northumberland Co., Penn, there being no legal barrier to such marriage; that her said husband died one mile from Pulaski, Mercer Co., Penn on the 27th day of March 1861, and that she has not remarried since his death; that at no time during the late rebellion against the authority of the United States, did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort; or exercised the functions of any office whatever under any authority, or pretended authority, in hostility to the United States; that she will support the constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purpose of being placed on the pension rolls of the United States, under the provision of the act approved February 14, 1871, and hereby constitutes and appoints, with full power of substitution and revocation, Benjamin F. Thomas of Andrew Jackson Co., Iowa, her true and lawful attorney..to prosecute her claim and obtain the pension certificate that may be issued; that her post office is at Fulton County of Jackson State of Iowa: that her domicile or place of abode is Fulton, Jackson Co., Iowa Mary X (her mark) Gearhart Attest: E. Holmes William Buchanan Also personally appeared Rachael Gearhart and Daniel Gearheart, Jr. residing in Fulton, Jackson Co., Iowa persons whom I certify to be respectable and entitled to credit, and who being by me duly sworn, say: They were present and saw Mary Gearhart, the claimant, make her mark to the foregoing declaration; that they have every reason to believe, from appearance of said claimant and their acquaintance with her, that she is the identical person she represents herself to be; and at no time during the late rebellion against the authority of the United States did she or her said husband adhere to the cause of the enemies of the Government, or give them aid or comfort; and that they have no interest in the prosecution of this claim. Holmes, clerk State of Iowa, County of Jones ss--On this 13th day of December 1873, personally appeared before me, a Notary Public, in and for the county and State aforesaid, Mary Gearhart, aged 77 years, a resident of the town of Madison, in Said county and State, who being duly Sworn according to Law, declares, that She is the Widow of Daniel Gearhart, that she was married to said Daniel Gearhart, in the month of June 1813, at Northumberland in the Town of Pint, County of Northumberland and State of Pennsylvania, by one Norberry, a Justice of the Peace in and for Town, County and State aforesaid, that her name before her said marriage was Mary Triester, that her husband died in the Town of Shenango, County of Mercer, State of Pennsylvania, on the 27 day March, 1861, and that She is still his widow, that there is no public record of her marriage, that She has made every effort to obtain such record evidence but fails to obtain it, and that She cannot furnish any other better evidence that that which she now produces. Mary X (her mark) Gearhart Sworn to and Subscribed, before me on the day and year first above mentioned and hereby certify that I know the said deponent, Mrs. Mary Gearhart to be respectable and worthy of credit and that I am not interested in her claim as Attorney or otherwise. signed John E. Lovejoy Notary Public State of Iowa County of Jones ss On this 13th day of December 1873 personally appeared before me a Notary Public in and for Said County and State aforesaid Daniel Gearheart, well known by me, a resident of the town of Madison county of Jones and State of Iowa, who being duly Sworn according to law doth depose and Say that his age is 47 years that he is the son of Daniel Gearhart, Sr. that he was born in the Town of Shenango, County of Mercer and State of Pennsylvania, that his father died at Shenango in the County of Mercer, Penn in the year 1861 and that his Mother Mary Gearhart, widow of said Daniel Gearhart, Sr. is now living with him, that he lived at home with his said father and Mother until he was 28 years of age, that his Said father and mother, Daniel and Mary Gearhart lived together from his earliest recollection up to the date of his death, as husband and wife, that his Said Mother has made every effort in her power to obtain Some Record evidence of her marriage or eye witness to the ceremony but that Said evidence cannot be obtained. Daniel X (his mark) Gearhart Sworn to and subscribed before me on the day and year first mentioned and I certify that I know the affiant to be a creditable person; and that I have no interest in Said claim. Lovejoy, Notary Public State of Iowa, County of Jones, Town of Madison ss On this 13th day of December 1873, personally appeared before me, a Notary Public in and for the County and State aforesaid Mrs. Martha Cameron aged 91 and Nathan Clark age 73, who being duly Sworn according to Law, declare that they are well acquainted with the family of Daniel Gearhart, Deceased, that they are also well acquainted with Mrs. Mary Gearhart, widow of said Daniel Gearhart, that they know that said parties lived together as husband and wife since the year 1813, until the time of his death which was in the year 1861, and that said Mary Gearhart has been Since that time and still is reputed to be his widow, which deponents know to be the fact, that they were not eye witnesses to the ceremonies of the marriage of said parties that deponents never heard the fact of their marriage disputed or questioned, that their knowledge of the above Statement is derived from the fact of their having lived in the same neighborhood with said parties for over fifty years. and that from their long and intimate acquaintance with Said parties they Verley believe that the Statements of Mrs. Mary Gearhart in regard to the date of her alleged marriage and the Services of her late husband, Daniel Gearhart, to be correct and true Statements Martha X (her mark) Cameron, Nathan (his mark) Clark Claim Of A Person who has never before had a Land Warrant, or made a Declaration therefore. State of Iowa, County of Jones, ss On this __day of September A.D. 1874, before me, the undersigned, a (1) Notary Public duly authorized by law to administer oaths within and for the County and state aforesaid, personally appeared Mary Gearhart aged 78 years, a residence of Centre Junction, in the County of Jones and State of Iowa, who being duly sworn according to law, declares that she is the identical widow of Daniel Gearhart who was a private in the Company__commanded by Captain Jacob Hummell War of 1812 that he (2) Enlisted at Northumberland, Penn, on or about the 1814.....She hereby appoints B. W. McClure of Centre junction, Jones Co. Iowa her true and lawful Attorney, with the power of substitution, to prosecute this her claim for land, to receive the Certificate or Warrant when issued, and to do all other acts necessary and proper in the premises. Mary X (her mark) Gearhart Signature of Claimant We Margaret Ann Gearhart and Martha Cameron residents of Centre Junction, in the state of Iowa, upon our oaths, declare that the foregoing declaration was signed and acknowledged by Mary Gearhart in our presence; and that we believe from the appearance and statements of the applicant, that she is the identical person she represents to be. That she is and always has been loyal to the Constitution and Government of the United States; that we have been acquainted with her for over thirty years, and testify from personal knowledge, and that we are not interested in her claim. Lovejoy, Esq. before whom the foregoing affidavits and power of Attorney were made and acknowledged, and who has thereunto subscribed his name, was at the time of doing so a Justice of the Peace in and for the county aforesaid, duly commissioned ....
