Judge W. W. Scott passed sentence. Clark had been previously charged with second degree murder in connection with the death of his father, following an argument between the two men, on April 14, 1946, when Clark is alleged to have struck his father and knocked him to the ground. Schoenthaler & Lee, local attorneys representing Clark, presented a petition carrying the names of 575 Jackson county persons requesting parole. In addition they produced 13 character witnesses who testified that Clark was the owner of a 115 acre farm, which he had improved and paid for through his own efforts.
