Page 384, 385 Last Will and Testament } } Will Geo W. Harlan } I, Geo W. Harlan of Ottumwa, Iowa, being of sound mind and memory do hereby make and publish this my last Will and Testament, hereby revoking all former Wills by me at any time heretofore made. That is to say: First. It is my will that all my just debts be first paid out of my estate. Second. I hereby devise and bequeath to my Wife Jennie Harlan the sum of Five Hundred ($500.00) Dollars, in Cash, the same to be received by her in lieu of dower, and all other interest in my estate, and in lieu of all claims and demands against my estate. She from this time on to sign all deeds and papers I may deem necessary in selling or disposing of any of the real or personal property I may now own, or may hereafter be possessed of, I hereby agreeing on my part not to make any alteration in this Will without her consent. Third. After the payment of my just debts and the above provision for my wife Jennie Harlan, do give, devise, and bequeath to my six Children, Mary A. McClung, Fannie F. Lewis, Alice C. McClung, Clara J. Smith, Hettie C. Rogers and Burt B. Harlan, all of my real and personal property of Every Kind and character whereon Situated, share and share alike, subject to the following conditions and provisions, to wit: 1st. That neither of said Children, their heirs, executors or assigns, shall make any claim whatever against my estate, unless said claim or claims are based upon notes or other instruments in writing, duly executed and signed by me. 2nd. If either of my said children, their heirs, executors or assigns, should make and establish a claim of any kind whatever against my estate which is not evidenced by a writing duly executed and signed by me, then the amount of said claim so established with interest and attorneys fees paid out by my estate in the defense thereof, shall be regarded to said extent as an advancement to said heir or heirs, and be taken as Such into account in the settlement and distribution of my estate. Witness my hand at Ottumwa, Iowa, this 8th day of December, A.D. 1897. Geo. W. Harlan, Testator. On this 8th day of December A.D. 1897 we, the undersigned, herby certify that on this date the testator Geo W. Harlan, in my presence signed and executed the foregoing Will and declared the same to be his last Will and Testament, and we, at his request, in his presence, and in the presence of each other, hereby sign our names as attesting Witnesses. Garriott Clerk of the District Court in and for said County do hereby certify that on this day at the April Term A.D. 1898 of said court the Will and Instrument in containing hereunto annexed, and bearing date on the 8th day of Dec 1897, was duly proved before and allowed by said court as and for the last Will and Testament of the real and personal estate of Geo W. Harlan late of said county deceased, and was by said court ordered to be recorded as such Will and Testament.
