Last Will and Testament of Mary McVey (Spinster)


I Mary McVey of Wapello County and state of Iowa do make and 

publish this my Last Will and Testament hereby revoking and making 

void all former Wills by me at any time heretofore made 

first I direct that after death my body be decently intered, and that my 

funeral be conducted in a manner corrisponding with my Estate and 

situation in life and as may be desired by my friends

2nd I direct that all my Just debts and funeral expences be paid out

of the first moneys that Shall come into the hands of my executor

from any portion of my Estate

3rd I direct that my house and Lot in the Town of Agency City in 

Wapello County and State of Iowa designated as Lot five (5) in Block 

four (4) on the Recorded plat of Agency City be jointly owned and held 

by my two Nephews John Wallace and Freeman McCoy.

4th I direct that all of my personal property consisting of Money Notes 

of Land book accounts household and Kitchen furniture bed and bedding 

and all other things of which I may be siezed at my death be owned 

and held by my Brotherinlaw Ashford McCoy and that he have 

and pofsefs the Same for his use and benefit.

5th I direct that one Coverlett in my pofsefsion but belonging to my 

Brother David McVey shall be sent to him at the earliest opportunity 

by said Ashford McCoy.

6th I hereby appoint Ashford McCoy executor of this my last will 

and Testament hereby authorising him and impowering him to com-

promise, adjust, release, and discharge, in such manner as he may

deem proper the debts and Claims due me

In testimony whereof I hereunto set my hand this

4th day of June A.D. 1860       Mary McVey

 

Signed and declared by the said Mary McVey in our presence and signed by 

us as Witnefses in her presence and in the presence of each other done on 

this 4th day of June A.D. 1860      John Pinkerton

Wapello County} We John Pinkerton and MC Crebiner of Lawful age being 

duly Sworn upon oath Say that at the time stated in the Last will and

Testament of Mary McVey as now presented and filed in the County Court 

of Said County was signed by the Said Mary McVey in the manner specified 

in Said Will -That the Said Will was executed in Our presence, that we 

were requested by Said Testator to sign the Same as Subscribing Witnefses 

thereto; which was accordingly done in the presence of Said Testator, and in 

the presence of each other. That the Said Mary McVey was at the time of 

executing 

her Said will of Sound Mind and Memory and not under any restraint 

and the Same was executed by her voluntary act and desire} M.C. Crebiner

Subscribed and Sworn to before me This 7th day of January 1860} John 

Pinkerton

Wapello County} I Joseph H Flint County Judge of the county court of Said 

County Certify that the last Will and testament of Mary McVey hereto annexed 

was on the 7th day of January 1861 duly proven up and allowed in open Court
