Henderson for embracery. The bonds in this case have been fixed at $500. In view of the facts which have came to light, proving how unjustly Mr. Henderson was accused in the case for mail robbery, the bonds in that case have been lowered from $3000 to $500. He has given the required bonds and is again in the bosom of his family, and allowed to breath the pure air of heaven. What looks strange in this matter is that Mr. Henderson's attorney should have allowed him to lay in the penitentiary for seven weeks, when he might have been kept from the penitentiary as far as the charge of embracery is concerned, if his attornies had taken an appeal immediately after the termination of the trial. It was clearly their duty to have done this because, should the Supreme Court order a new trial, the seven weeks of imprisonment which Mr. Henderson has suffered will count as nothing. And it seems rather strange that as soon as the real robbers were captured, Mr. Henderson was not brought before the Judge on a writ of Habeas corpus and discharged from custody for mail robbery, of which it is now positively known he was innocent. We can see no excuse for this unless it is that Mr. Henderson's attorney's were certain that the old fogy Chief Justice of this territory would grant nothing until the public would express their desire by a petition.
