H J Cortner) Plaintiff) vs) Thomas L Simpson,) DECREE Carrie Simpson and F A Dorey) Defendants) This cause having been regularly called and tried by the Court and findings of fact and conclusions of law having been made and filed, wherein the judgment was awarded in favor of H J Cortner plaintiff against all of the defendants as prayed for in the complaint: Now, on motion of Ira W. Kenward, plaintiffs attorney, It is hereby ordered adjudged and decreed that the plaintiff have judgment as prayed for in his complaint herein against the defendants, and each and all of them, that all adverse claims of the defendants and each of them, and all persons claiming or to claim said premises or any part thereof through or under said defendants, or either of them are hereby adjudged and decreed to be invalid and groundless; and that the plaintiff be and he is hereby declared and adjudged to be the true and lawful owner of the land described in the complaint and herein after described and every part and parcel thereof, and that his title thereto is adjudged to be quieted against all claims demands or prepensions of the defendants or either of them who are hereby perpetually estopped and enjoined from committing any waste or trespass in or upon said land or any part thereof and form sitting up any claim thereto or any right title or interest therein or any part thereof. And the plaintiff is hereby decreed to be entitled to the possession with the right of possession of each and every portion of said land, and is entitled to, and is hereby decreed a writ of possession restoring to him each and every portion of said land as against the defendants and each of them and any and all persons by or through them claiming the same. The injunction heretofore issued against the defendants is hereby made perpetual. Said premises are bounded and described as follows: “The north east ¼ of the south east ¼ and lots 1 and 2 in Section 32; lot 6 in Section 33 and lot 1 in Section 29 all in township 9 north range 5 West Boise Meridian” that the above described land lies on the West side of Payette River near where said river empties into the Snake River continuously for a distance of about one mile and that said land is bounded on the east side by the said Payette river. That the said Payette river along the east boundary of said land is a non-navigable stream. That plaintiffs right, title and interest in and to the above described lands and his possession and right of possession therein at all times extended to and is and was bounded by the thread of the Payette River as the east boundary line thereof. That the thread of Payette river is the east boundary line of said river and not the meander line as shown by the field notes of the government survey of said lots, and the government plats thereof.
