W. Hunt To W. H. Philbrick This indenture made and executed on this the 6th day of March A. D. 1867 between George W. Hunt of the county of Ada and Territory of Idaho party of the first part and W. H. Philbrick of the same place party of the second part Witnesseth; that the said party of the first part for and in consideration of the sum of Four Thousand Dollars to him in hand paid by the party of the second part, the receipt whereof is hereby acknowledged has granted, bargained sold conveyed and quit claimed and by these presents does hereby grand bargain sell convey and forever quit claim unto the said party of the second part, his heirs and assigns forever, All that certain piece, tract or parcel of land in said county and territory lying and being situated on the south side of the Payette River on the stage road leading from Boise City to Umatilla at what is known as the lower crossing of said piatt river and known as the Bluff Station properly and bounded as follows; commencing at the Bluff Station house on the south side of said river and thence running up said river one hundred and sixty rods, thence south one hundred and sixty rods, thence in a western direction and parallel with said river three hundred and twenty rods, thence north one hundred and sixty rods to said river thence up said river one hundred and sixty rods to the place of beginning containing three hundred and twenty acres of land also the fery, ferry right, and franchise on and a crop said Piatte River at said Bluff Station house and property and the ferry boat, wire rope instruments and tackle belonging to said ferry and used thereat together with all the buildings tenements and improvements, rights privileges and appurtenances to said property and ferry belonging or in any manner appertaining. To have and to hold the same by him the said party of the second part, his heirs and assigns forever. This conveyance is intended by the parties thereto and hereby declared to be a mortgage to secure the payment of a certain promissory note made by the party of the first part to pay to the party of the second part the sum of Four Thousand Dollars and bearing even date herewith which note is in the words and figures following to with; $4,000.00 Boise City March 6th A. D. 1867 Twelve months after the date I promise to pay W. H. Philbrick or order the sum of Four Thousand Dollars in gold coin for value received Signed G. W. Hunt Now if the said party of the first part shall pay and fully satisfy and discharge said promissory note on or before its maturity according to its tenor and effect then these presents are to be null and void but in case default me made in the payment of th same or any part thereof then these presents are to be and remain in full force absolute and in case of such default said party of the second part is hereby authorized to sell said land, premises property according to law and out of the proceeds of such sale to pay the costs and charges of the same and to retain and hold to his own use a sufficient amount to pay what many then be due him on said note and the overplus if any to be paid to the party of the first part his executors, administrators or assigns. Hunt personally known to me to be the person who signed this foregoing instrument of writing and acknowledged to me that he had executed the same freely and voluntarily and for the uses and purposes therein expressed.
