Henry Sick Plaintiff vs Rufus A Emery, Jennie B Emery, J W Herrington, and all unknown heirs of Martha W Harrington, deceased, nee Martha W Emery, and all unknown heirs of Rufus Emery, deceased Defendants) DECREE This cause coming on regularly to be heard and it appearing to the Court that defendants and each of them have been duly summoned in this cause as provided by law, and the default of defendants and each of them having been duly entered, herein, they having failed to answer, demur or plead to plaintiffs complaint herein, and the plaintiff appearing by his attorney, H E Wallace, and the Court having seen and understood the pleadings in this cause and having heard the evidence adduced, doth from the law, the evidence and the premises find, and it is hereby ordered adjudged and decreed that the plaintiff have judgment as prayed for in his complaint herein against the defendants and each and all of them; that all adverse claims of defendants, and each of them, and all persons claiming or to claim said premises, or any part thereof, through or under said defendants, or either of them, are hereby adjudged and decreed to be invalid and groundless, and that the plaintiff be and he is hereby declared and adjudged to be the true and lawful owner of the land described in the complaint and hereinafter described, and every part and parcel thereof, and that his title thereto is adjudged to be quieted against all claims, demands or pretentions of the defendants or either of them, who are hereby perpetually estopped from setting up any claims thereto ir any part thereof. Said premises are bound and described as following, to-wit: The west half of the Northeast Quarter of Section fourteen, township eight, north-range five west of Boise Meridian in Canyon County State of Idaho: And it is hereby further ordered, adjudged and decreed that the plaintiff do have and recover his costs herein, against defendants herein.
