Redington Articles of Agreement made this eighteenth day of September in the year of our Lord, one thousand eight hundred and eighty six, between David Gorrie, Jr. of Payette County of Ada, Territory of Idaho, party of the first part and William E. Redington of Cedar Mills, County of Meeker, State of Minnesota, party of the second part, Witnesseth, that said part of the first part hereby covenants and agrees, that if the party of the second part shall first make the payments and perform the covenants hereinafter mentioned, on his part to be made and performed, the said party of the first part will convey and assure to the party of the second part, in feesimple, clear of all incumbrances whatsoever, by a good and sufficient warranty deed, or as soon thereafter as a patent for the same has been issued by the U. S. Government, the following piece or parcel of land viz: ten acres in the following form, Eighty rods east and west, by 20 rods North and South being situated on the North side of the S. W. 1/4 of the S. E. 1/4 of Section 28, Town nine North Range five West Boise Meridian, in the County of Ada, Territory of Idaho, and the said party of the second part hereby covenants and agrees to pay to said party of the first part the sum of four hundred ($400.00) dollars, on or before September eighteen in the year of our Lord one thousand eight hundred and ninety with interest at ten per centum per annum, to be paid annually, on the whole sum remaining from time to time unpaid and to pay all taxes, assessments or impasitions, that may be legally levied or impased upon said land, subsequent to the year 1886, and in case of the failure of the said party of the second part, to make the payments, or to perform any of the covenants on his part hereby made and entered into this contract, shall at the option of the party of the first part be forfeited and determined, and the party of the second part shall forfeit all payments made by him on this contract, and such payments shall be retained by the said party of the first part, in full satisfaction and in liquidation of all damages by him sustained, and he shall have the right to reenter and take possession of the premises aforesaid, with all the improvements and appurtenances thereon, paying the said William E. Redington the appraised value of said improvements and appurtenances, said appraisment to be made by three arbitrators, one being chosen by each of the said parties, the other being chosen by the first two. And it is further agreed by the party of the first part, that one fourth interest one share of water shall go with the above described panel of land, without any extra consideration. It is mutually agreed, that all the covenants and agreements, herein contained shall extend to and be obligatory upon the heirs, executors, administrators and assigns of the respective parties.
