WILLIAM H. UPCHURCH and ADELIA UPCHURCH, husband and wife, to THE PUBLIC. KNOWN ALL MEN BY THESE PRESENTS: That we, William H. Upchurch and Adelia Upchurch, husband and wife, of Boise, County of Ada, State of Idaho, do hereby grant, convey and dedicate to the public for public use for burial of human bodies and the free use thereof for the purposes of such burial of for the removal of bodies therefrom now buried therein, and for maintenance, improvement, beautifying and care thereof, with right to enclose same by fence, such fence to be provided with gate which will permit free ingress and egress to said lands, the cemetery known as Washoe Cemetery located in Payette County, Idaho and particularly bounded and described as follows, to-wit: Commencing at the Northwest corner of the Southeast Quarter of the Northwest Quarter of Section Nine, Township Eight North, Range Five West, B. M., and running thence East on and along the North boundary line of said 40 acre tract 154 feet; thence South 223 feet; thence West 138 feet; thence North 60 feet; thence West 16 feet to the West boundary line of said 40 acre tract; thence North and along said West boundary line 163 feet to the place of beginning, and containing .766 of an acre. And we hereby covenant that we are lawfully siezed of said lands and premises and that we have good authority to dedicate same for the purposes aforenamed. Provided, that this dedication is expressly conditioned that no use shall be made of said lands inconsistent with its use as a public cemetery, and that no one shall be denied use thereof for such purpose or the free ingress or egress thereto.
