State of Idaho) County of Canyon) ss In the District Court of the Third Judicial District of the State of Idaho, within and for said county. Sarah P. Gorrie Plaintiff vs David Gorrie Defendant This cause came on regularly to be heard in open Court on this twelfth day of December 1895. James J. Rogers appearing for plaintiff and defendant not appearing and whose default for not appearing and answering to plaintiffs complaint herein has been duly entered. The plaintiff having brought her witnesses into Court to be examined and the Court having heard all the evidence and proof produced herein and duly considered the same, and being fully advised in the premises and it appearing therefrom to the satisfaction of the Court that there is no legal exceptions as to the competency , admissibility or sufficiency of said evidence, and that every material allegation in plaintiff’s complaint has been established, to-wit: FIRST That David Gorrie above named defendant has been duly and regularly summoned to answer unto plaintiff’s complaint herein, and that said defendant has made default in that behalf and that said default for not appearing and answering plaintiff’s complaint has been duly and regularly entered herein. SECOND That plaintiff has been a resident of the State of Idaho for more than a period of six months immediately preceeding the beginning of this action. THIRD That plaintiff and defendant on the twelfth day of June 1881 at Weiser, Idaho, inter-married and became husband and wife, and ever since have been husband and wife. FOURTH That there is now living of the issue of said marriage two minor children, to-wit: Walter Erastus Gorrie aged 12 years, and Eda Gorrie aged 4 years. FIFTH That on the 13th, day of October 1894, said defendant did desert and abandon the said plaintiff, without just cause or provocation for such desertion and with out the consent and under the protest of the said plaintiff, and that the said defendant has continued to so abandon the said plaintiff from the said 13th day of October 1894 to the beginning of this action, and still abandons said plaintiff. Wherefore on motion of James J Rogers attorney for plaintiff it is hereby ordered, adjudged and decreed and this does hereby order adjudged and decree, that the said marriage be disolved, and the same is hereby disolved, and the parties are and each of them is freed and absolutely, released from the bonds of matrimony and all the obligations thereof. SECOND And it is further ordered adjudged and decreed, that the custody of the said minor children of the said plaintiff and defendant, to-wit: Walter Erastus Gorrie aged 12 years and Eda Gorrie aged 4 years, be, and they are hereby awarded to plaintiff. THIRD And for the costs and disbursements prayed for and for general relief, Said costs amounting to the sum of $26.55/100.
