A. Jacobsen, Deceased. ) DECREE OF DISTRIBUTION Annie Jacobsen, having on the 26th day of September, filed her petition, setting forth among other things, that her final account is in condition to be settled and said estate is in condition to be closed, and that a portion of said estate remains to be divided among the heirs at law of said deceased in the manner provided by law. Said matter coming on regularly to be heard this 30th day of September, 1933, at the hour of three o’clock P.M., upon due proof that due and legal notices of said hearing has been given as provided by law and the order of this Court heretofore m ade, said administratrix Appearing in person and by her counsel, Geo. Donart, and Herman Walker appeaing as guardian ad litem for Wilma Jacobsen, a minor granddaughter and heir of the said N. A. Jacobsen, deceased, the Court proceeded to hear said petition, and it appearing to the satisfaction of said Court that the residue of said estate, consisting of property hereinafter particularly described, it now ready for distribution, and that the said estate is now in condition to be closed; From the evidence introduced, the Court hereby finds: That N. A. Jacobsen and one N. Adolph Jacobsen, hereinafter mentioned as one of the record owners in the stock certificates hereinafter mentioned, were one and the same person; That all of said property was community property of the said Annie Jacobsen and N. A. Jacobsen, sometimes known as N. Adolph Jacobsen: That the said N. A. Jacobsen died, intestate, in the county of Payette, state of Idaho, on February 10th, 1933, and was, at the time of his death, a resident of the county of Payette, state of Idaho; That the heirs at law and next of kin of the said N. A. Jacobsen are: Annie Jacobsen, his surviving widow, residing at Payette, Idaho; Arno Jacobsen, a son, residing at Pocatello, Idaho; Arma Steele, a daughter, residing at San Francisco, California; Belle Sur, a daughter, residing at Payette, Idaho, all of whom are over the age of twenty-one years; Noland Jacobsen, a Grandson, aged 22 years, residing at Payette, and Wilma Jacobsen, a granddaughter, aged 16 years, residing at Payette, Idaho; That all claims against said estate are fully paid and all taxes due from the said estate have been paid, including the inheritance tax due the state of Idaho, and that no inheritance tax is due to the Government of the United States from said estate. That since the rendition of her final account no money has come into the hands of said administratrix belonging to said estate and none has been by her disbursed, and the estimated cost of closing the estate will be the sum of Five ($5.00) dollars; That all of said property is community property of the said N. A. Jacobsen, sometimes known as N. Adolph Jacobsen, and Annie Jacobsen, his wife, and by virtue of the law of the state of Idaho, the said Annie Jacobsen is entitled to have all of said property decreed and distributed to her; NOW, THEREFORE, On this 30th day of September, 1933, on motion of Geo. Donart, attorney for said administratrix, it is hereby ORDERED, ADJUDGED and DECREED that all of the property belonging to the estate of N. A. Jacobsen, sometimes known as N. Adolph Jacobsen, and hereinafter particularly described, be and the same is hereby decreed, distributed and set over to the said Annie Jacobsen, unconditionally and without reservation, and that the description of such property so distributed, decreed and set over to the said Annie Jacobsen is as follows, to wit: Personal property described as follows: Cash in Payette State Bank; Cash in First National Bank, Boise. Note of Albert Wilson, principal sum $1000.00 secured by a mortgage on Malheur County, Land. Note of A. J. McClanahan, H. B. Salterbake, M. G. Reimers, J. D. Reimers, Charles T. Craven, principal sum $1000.00, dated May 19, 1930. Note of William Maule in the sum of $782.00 7 ¼ shares of the Mutual Cole Company; 7 shares of Idaho Oregon Petroleum Company; 5 shares Marconi Wireless Telegraph Company. Household furniture and fixtures and motor vehicles. Corporate stock issued in the name of N. Adolph Jacobsen and Annie Jacobsen, as joint tenants with right of survivorship, and not as joint tenants in common; 52 shares, Standard Oil of California; 31 shares, Radio Corporation of America; 150 shares, Studebaker Corporation; 21 shares, Safeway Stores; 30 shares, Hudson & Manhattan Ry. Co. 125 shares, Taylor Milling Corporation. 30 shares, Massachusetts Investors Trust Co., 100 shares, Jantzen Knitting Mills (Common) 31 shares, B. F. Slessinger & Sons. Real Property described as follows: Beginning at a point located 264 feet West of the Northeast corner of the Northwest quarter of the Southeast quarter of Section 27, Township 9 North, Range 5 West B. M., running thence South 3* 38’ East 378 feet; thence South 40* 28’ East 284 feet; thence South 81* 28’ East 35 feet, more or less to the center of the Lower Payette Ditch; thence South 192 feet to the Southwest corner of land owned by Peter Sodja; thence West 1274 feet; thence North 437 feet; thence East 624 feet; thence North 349 feet; thence East 432 feet, more or less, together with the Eight shares of stock in the Lower Payette Ditch Company, Ltd., also all lateral and ditch rights appurtenant thereto, said tract being known as the old Searson Place. Lot 3 and Lot 10, all in Block 1 Gorrie’s Addition to the city of Payette, Idaho, also Lots 11 to 14 inclusive, all in Block 2 of Gorrie’s Addition to Payette, Idaho, also a one-half interest in the brick wall situated on the line between Lots 14 and 15 of Block 2 of Gorrie’s Addition to the city of Payette, Idaho; Also Lots 12 and 16 inclusive, Block 5, all in Jacobsen addition to the city of Payette, Idaho. Block six and Lot 1 of Block Seven in Section 34, Township 9 North, Range 5 West B. M., containing 23.91 acres. Tax No. 4 of Lot 2 of Block 7 and all of Block 8 in Section 34, Township 9 North, Range 5 West, B. M., containing 30.53 acres. The above described lands being otherwise described as follows: All of the South half of the Northwest quarter of Section 34, Township 9 North, Range 5 West of Boise Meridian, lying and being East of 11th Street of the City of Payette, Idaho, as shown by plat thereof approved by the City Council April 6th, 1911, and excepting therefrom such portions as have been included in Jacobsen’s addition to the city of Payette, also excepting therefrom the strip of land 750 feet by 300 feet lying between Center Avenue and First Avenue North and between Twelfth Street and Fourteenth Street as shown by the plat of the city of Payette, Idaho, which latter excepting has been deeded to Independent School District #32 and also excepting therefrom the following tract; A tract of land described as Tax No. 3 of Lot 2 in Block 7, in said Section 34, Township 9 North, Range 5 West of Boise Meridian, heretofore deeded to Independent School District No. 32. Together with any and all other property, whether real, personal or mixed, belonging to the estate of said N. A. Jacobsen, and/or which the said N. A. Jacobsen, sometimes known as N. Adolph Jacobsen died, seized or possessed, or in which he was entitled to any interest at the time if his death, whether now known or discovered and wheresoever situate.
