Deceased had been working all night, and came up on the west cage with nine others about 5 o’clock a. m. When he stepped off the cage at the upper landing, he turned to the left and walked into the east chamber of the shaft, falling a distance of 342 feet. The gate on the east chamber of the shaft being up about five and one-half feet, leaving the chamber unprotected. The shaft being the upcast, a cloud of steam was hanging over it, making it difficult for the men to see their way from the cage in the dark. There were no lights around the top, nor no man to safely see the men off the cages, as required by law.
