He was in a sitting position between two timbers about four feet from the shaft, and while the cagers were cross-caging a trip of empty cars from the south to the north side of the shaft, the trip being being pulled by a mule team, jumped the track and caught deceased’s head between it and the timber, killing him instantly. Deceased had been told several times by the cager and others, to get to a more safe place, but being anxious to get on the cage as soon as he could, would not leave.
