All rights reserved. http://www.usgwarch.org/copyright.htm http://www.usgwarch.org/il/ilfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: John & Cindy McCachern mccachern@sbcglobal.net CLARK CO. – ESTATE SETTLEMENT OF MICHAEL BLANKENBAKER 1789 Virginia file -------- Original Message -------- Subject: For Culpeper Co, VA, usgenweb archives    Date: Mon, 27 Jan 2003 17:04:42 -0600    From: "John & Cindy McCachern"      To: "Linda Lewis" Estate Settlement of Michael Blankenbaker 12 November 1789, Culpeper County, VA To all whom this present writing may concern, know ye that whereas Michael Blankenbaker of the county of Culpeper and State of Virginia departed this life without leaving any will behind him and in order to save the expense of administration, the widow and children of the said Blankenbaker have unanimously agreed to have the said estate divided among them by George Hume, Mark Finks and George Chrisler Jr.  Which when they have divided the aforesaid estate shall make out an account of the widow's and each child's part of the said estate distinctly with the notation of each article.  Extended, which said list shall be here unto executed and if there should at anytime hereafter come any lawfull claim or claims against the said estate, such as debts, therein that case all the children of the aforesaid Blankenbaker shall pay an equal proportion of them.  When such a division shall be made, we the subscribers hereby agree and acknowledge that the same shall be binding toward their heirs and administrators as if there had been an administration on the said estate agreeable to law.  In order to confirm and enforce the aforesaid articles to stand good and valid, we Elizabeth Blankenbaker, widow of the aforesaid Blankenbaker deceased, John Wilhoit, John Clore, Ephriam Utz, Elias Christler, Lewis Wilhoit, Imma Chriglar and Mary Wilhoit all of the county and state aforesaid do bind each of them, their heirs, executors and administrators in the full and part sum of five hundred pounds current money of Virginia.  On the condition that if any one or more of them, their heirs, executors, administrators shall at any time here after claim any part of the aforesaid estate more than what is set apart for them by aforesaid executors who are appointed to divide the aforesaid estate or refuse to pay their proportion of any lawful debt that shall come against the said estate when demanded shall forfeit and pay the aforesaid five hundred pounds to each party, their heirs, executors and administrators which shall be agreed by such claim over su.  But in case the parties whose names are here unto subscribed shall agree to comply with the aforesaid articles when the above obligation shall be void otherwise to be.  It remains in full force, power, control at law.  In witness where of the parties here unto set their hands and fixed their seals this 12th day of Novemeber 1789.
