And your petitioner represents and shows unto your Honor that by deed bearing date the 21st day of February 1860 one Artenias Carter being the owner of the premises herein after described conveyed unto one THOMAS NORTON the following described premises situated in the County of Cook and State of Illinois to wit: Sublot thirteen in the Carters Subdivision of Lot four in Black Forty-four in the Canal Trustees Subdivision of the West half and a part of the South east Quarter of Section twenty-one town thirty-nine North of Range Fourteen East of the third principle meridian. That on the 19 day of August 1874 said THOMAS NORTON, being still the owner of said premises died in testate leaving him surviving his widow Mary Norton and his only child named James Norton and he left surviving no other child or descendant of any deceased child. That by the death of said THOMAS NORTON the said James Norton as the only heir at law of said THOMAS NORTON, became the owner of said premises subject only to the right of dower of said Mary Norton. That the title and interest of said James Norton and Mary Norton, by mesne conveyances has been vested in the petitioner and this petitioner is now the owner and has the title to the said premises. That your petitioner is desirous of establishing the facts above set forth with reference to the death of the said Thomas Norton and the widow and heir who he left him surviving and of perpetuating the evidence of such facts. That DENNIS NORTON, 125 Elk Grove St and PETER NORTON, brothers of said THOMAS NORTON deceased are witnesses who can testify to the said facts desired to be established and petitioner wishes to have them examined in relation thereto. That these are persons interested in the subject concerning which petitioner desires to perpetuate the evidence as aforesaid whose names are unknown to this petitioner and there are no other persons interested therein.
