Saunders minor child of George Saunders Dec’d under the act of Sept 28th 1850 admitted for 80 acres Warrant No 30,372, New York Mil in which case service service was alleged in Capt Archibald Campbell’s Co NY Mil and a report made by the Third Auditor Jany 27th 1852 that said Saunders served in Capt Campbell’s Co NY Mil from March 12th to April 9th 1814. May I ask a re-examination of the case of Nancy Green with reference to the facts above stated. Respectfully Bray H Baldwin 8. Handwritten Letter: Washington Sept 21, 1855 Hon J. Minot Comm of Pensions Sir, I beg [hear] to file herewith a letter from M. H. Wygant the atty in the case of Nancy Green widow of Luke whose claim for bounty land under act of Sept 28th 1850 is suspended, the same having been filed by M. Wygant from New York. Mrs Green claimed that her husband served under Captain Gaylord of the New York Militia. Whereas it [and] appear that said Gaylord was a Colonel. From others who served from same town with claimants husband it is supposed that he may have served under Capt Jedediah Noble or Captain Archibald Campbell both of N York Mil. Will you please refer the papers to the auditor for an Ex’m of these rolls. Respectfully Bray H. Baldwin 9 & 10. Handwritten Letters: Almond Sept 15 1854 Dr Sir I am stuck on a couple of bounty land claims. One is an application of Nancy Green filed by me in 1851 for land by services of Luke Green Dec’d. The service was claimed in Geo Gaylords Co. and the report was in rolls on file of that Co. The probability is that Gaylord was the Col instead of Captain but I can find no clue by which to identify the Co in which he served. It may be that of Capt Archibald Campbell or perhaps Jonathan Noble Colonel Dobbins Regiment may be looked into. There is also another [con] heir the heirs of Reuben Manroe or Monroe who probably served with Green. The heir of George Saunders has drawn a warrant on 80. The heir was Louisa Saunders and I think Saunders must have served with there. These are the cases in which the officers can not be designated but all else is straight and right and if you can look up their names on the rolls I will do the rest of the [busenis] and then will divide the profits equally or any other way satisfactory. There was a whole company sent from here in the war of which I send you a mem and non have decided by omission of the captain to file his muster roll. What can be done with them? The heirs of James McHenry are also entitled and he probably served with Green or Monroe and was also in Van Campen’s Co. All the Captains I can refer you to are Higgins, Kennedy, Noble, Campbell and hope we may find one of them there. You will please write me. Yours [& C] M. H. Handwritten Letter: Almond Allegany County New York Sep 13th 1856 Hon J. Minot Dr Sir Enclosed find a new application for Nancy Green widow of Luke Green under act of 1855. I made an application under the act of 1855 but she mistook the officers name. It was No 109,876. We think she has now ascertained the names of the officers under whom the service was made. Handwritten Letter State of Illinois Fulton County This day personally appeared before me the undersigned an acting Justice of the Peace within & for said County, William Thompson who being duly sworn on his oath says that he was well acquainted with Luke Green (the husband of Nancy Green) in his lifetime- that he the said Luke Green departed this life on the 29th day of April AD 1842 at Canton, Fulton County Illinois that he made the coffin for the said Luke Green deceased and attended his funeral at the time of his said death and further this deponent saith not. Handwritten Letter Within & for Said County John Thorp who being duly sworn according to law on his oath says that he was well acquainted with Luke Green the husband of Nancy Green in his lifetime and was well acquainted with him from the year Ad 1814 up to the time of his decease. I saw him engaged in the United State Army in the year 1814 and saw him engaged as one of the guards in taking prisoners to Greenbush in the state of New York which prisoners were taken at the time of Perry’s Victory on Lake Erie. The said Luke Green came to Canton Fulton Co State of Illinois sometime in the year AD 1837 and died at the same place sometime about the 29th day of April 1842. Your affiant further states that he said the said Luke Green after his decease & attended his funeral at the time he was buried. Your affiant further states that (page 15) the widow of the said Luke Green removed from this place (viz Canton Fulton Co Illinois) to Allegany County & state of New York about four years ago and that your affiant accompanied her to said county and state. Affidavit of Nancy Green 1858 Allegany County State of New York On the 24th day of June 1858 Nancy Green being duly sworn deposeth and says that she is of the age of seventy-five years now lives in the town of Alfred in said county of Allegany, that she is the identical person who filed or entered a claim in the Pension Office for bounty land under the act of March 3 1855 which claim was No. 257,218 and founded upon the fact that she is the widow of the late Luke Green who rendered service in the war of the United States with Great Britain in the year A.D. 1814. She says that her said husband the said Luke Green, was drafted at Alfred in said county and that he left home in the service about the 10th or 15th of September 1814 that he remained in said service three months and returned home in the following December She further says that Edward Green, Reuben Monroe, William Saunders and james Fisk were also drafted, left home with and this deponent believes served with and in company with her said husband; that during the summer or autumn of 1815 her said husband the said Luke Green went to Batavia in the sate of New York and there received pay for three months service. At the time of her application this deponent believed her husband to have served under Capt. Campbell & Noble but since that time she has received information and does now believe that her said husband the said [Luke Green] ………[here begins page 20]…. [parts or page missing between] …… and that she is the person now present who signs and executes the within above instrument. [No signature showing] …[Document overlaps the following beginning: And the said Clark Crandall upon his part and for himself further saith that he is of the age of seventy-three years that he became a resident of the town of Alfred the year one thousand eight hundred and eight that in the year A.D. 1811 he was commissioned Captain of the Militia of the town of Alfred and that he was such captain during the later war with Great Britain and longer that he this deponent did not go into the service but members of his company were drafted several times during the war by orders of his colonel this deponent always attended to the drafting in person that about the first part of September 1814 Luke Green then a resident of Alfred in said county aforesaid and a member of this deponents company of Militia was drafted to go upon the “lines” into service of the United States by Order of the Commanding Colonel and verily believes that he did go into such service and remained in such service several months and further this deponent says that he knows the above named Nancy Green to have been the wife of the said Luke Green at that time. Clark Crandall John Woolworth Subscribed to and affirmed before me this 24th day of June A. D. 1858 and [page 21 begins] certify that the said Clark Crandall and John Woolworth are credible and respectable citizens. A.E. Crandall, J.P. State of New York Allegany County Mrs. Esther Coon being duly sworn deposes and saith that she is a resident of the town of Alfred in the county of Allegany that she has resided there since the fall of 1814 that she with her parents moved from Rensalaur Co. N.Y. to Alfred in November of the year A.D.1814. That at Manlius Corners through which she passed she saw Luke Green whom she knows to have been the deceased husband of Mrs. Nancy Green together with William Saunders and other soldiers having charge of British prisoners to be taken to Greenbush, that a few weeks after she saw him at Manlius Corners he returned to Alfred and resided there some twenty years thereafter, and this deponent further says she is of the age of sixty-two years. Form of Declaration for the Widow of a deceased Officer or Soldier State of New York, County of Allegany On this fourth day of September A.D. one thousand eight hundred and fifty six personally appeared before me a justice of the peace in and for the county and state aforesaid, Nancy Green aged seventy two years a resident of Alma Allegany County in the state of New York, who being duly sworn according to law , declares that she is the widow of Luke Green deceased, who was a private in the company commanded by Captains Campbell & Noble in the ____ regiment of New York Militia commanded by ______, in the war with Great Britain, declared by the United States in 1812, that in her former application she gives her best knowledge & belief as to the circumstances of the service of her said husband….[many blanks left blank]…… She further states that she was married to the said Luke Green in Petersburg New York on the third day of December in A.D.1804 by one John Green, a Justice, and that her name before marriage was Nancy Murphy; that her said husband died at Canton Illinois on the 27 day of April A.D. 1842 and that she is now a widow. She further declares that she has heretofore made application for bounty land under the act approved Sep 28, 1850, No 109876 now suspended & no others and she refers to her former paper for proof of marriage and of her husband’s death. She makes this declaration for the purpose of obtaining the bounty land to which she may be entitled under the “act approved March 3, 1855”. Affidavit by Rodman Place State of New York Allegany County On this 12th day of June A.D.1851 before me the undersigned a justice of the peace in and for said county and state comes Rodman Place who being duly sworn says that his age is sixty-seven years that he resides in the town of Alfred in the county of Allegany that in the year eighteen hundred and four he resided at Petersburg in the County of Renselaer State of New York. That at that time Luke Green Nancy Murphy and John Green Esq resided at that place and that this deponent was personally acquainted with each of the aforesaid individuals. That this deponent well remembers that some time about that year the said Luke Green and Nancy Murphy were reported to have been married by the said John Green Esqr. That for many years this deponent continued to reside at Petersburg aforesaid and the said Luke Green and Nancy soon after removed [to] Brookfield Madison County New York and also continued to live as husband and wife as reported. That some years after the family of this deponent and of the said Luke Green came to the county of Allegany where they continued to reside until about the year 1839 when the said Luke Green removed to the state of Illinois. That about the year 1842 this deponent received information from various sources and from the relatives of the said Luke Green and believes it to be true, that the said Luke Green died at Canton in the sate of Illinois. That some four years since Nancy Green widow of the said Luke returned to the neighborhood of this deponent in the said County of Allegany and has since remained there (page 26). This deponent further saith that the said Luke Green dec’d former husband of the said Nancy Green sometime during the later period of the last war with Great Britain left home and was slated and as this deponent believes to be true to serve in the Army of the United States and was absent some months. This deponent further saith that the said Nancy Green as he is informed and believes to be true has since the death of the said Luke Green until the present time remained and is now the widow of the said Luke Green [Signature] Rodman Place Subscribed and sworn this day and year aforesaid before me and I further certify that the said Rodman Place is personally known to me and that his statement above is entitled to full credit. Affidavit by Rhoda Sweet State of New York Allegany County On the sixteenth day of June eighteen hundred and fifty one come before me Rhoda Sweet who being duly sworn deposeth and says that she is of the age of sixty one years. That she resides in the town of Cancadea in said county of Allegany. That she has for fifty years personally known and been acquainted with Nancy Murphy since the wife and now the widow of Luke Green. That during the year 1804 she resided at Petersburg in the county of Renselaer. That she was with and personally acquainted with the said Luke Green and John Green Esq then a Justice of the Peace in that town. That on or about the twenty third day of December of that year she was present and saw the said Nancy Murphy married to the said Luke Green by the said John Green Justice of the Peace as aforesaid. That the said Luke and Nancy Green have lived together as husband and wife since the period of their said marriage and until the death of the said Luke Green which this deponent is informed and believes took place about the year 1842. Affidavit of Nancy Green State of New York County of Allegany On this first day of June A.D. one thousand eight hundred and fifty one personally appeared before me a Justice of the Peace within and for the County and State aforesaid Nancy Green aged sixty seven years a resident of Alfred Allegany County State of New York who being duly sworn according to law declares that she is the widow of Luke Green deceased who was a private in the company commanded by Captain George Gaylord but in what particular Regiment she cannot state in the war with Great Britain declared by the United States on the 18th day of June 1812; that her said husband was drafted at Alfred aforesaid on or about the twentieth day of September A.D. eighteen hundred and fourteen for the term of three months and continued in actual service in said war for the term of three months within a few days and was honorably discharged at Black Rock on Niagara River on or about the fifteenth day of December eighteen hundred And fourteen as will appear by the muster rolls of said company the original discharge having been lost. She further states that she was married to the said Luke Green at Petersburg in the County of Renselaer State of New York on the twenty third day of December eighteen hundred and four by one John Green Esq a Justice of the Peace. That there is no record of said marriage in existence to the knowledge of declarant. That her name before her said marriage was Nancy Murphy That her said husband died at Canton in the State of Illinois on the twenty ninth day of April A.D. eighteen hundred and forty two and that she is still a widow [page 29] She makes this application for the purpose of obtaining the bounty land to which she may be entitled under the act granting bounty lands to certain Officers and Soldiers who have been engaged in the military service of the United States passed September 28th 1850. Demand for Information War of 1812 Department of the Interior Pension Office Washington D. C. February 2nd 1872 Madam, In the claim of Nancy Green for a widow’s pension under act of February 14 1871, No 4716 proof of her marriage to the soldier prior to December 24 1814 [written above in handwriting Febr’y 17th 1815] is required. You are informed that proof upon this point is of value in the following order: 1. A certified copy of a church or other public record. 2. An affidavit of the officiating clergyman or magistrate. 3. The testimony of two or more eye=witnesses of the ceremony. 4. The testimony of two or more witnesses who know the parties to have lived together as husband and wife from the date of their alleged marriage, the witness stating the period during which they knew them thus to cohabit. Before any of the lower classes of evidence can be accepted, it must be shown by competent testimony that none higher can be obtained. Return this circular with the evidence Very respectfully, J. H. February 24 1872 Madam, In the claim of Nancy Green for a widow’s pension under the act of February 14, 1871 No. 4716 the evidence filed in proof of marriage cannot be accepted as conclusive. In furnishing evidence of cohabitation the witnesses must swear to a specified period during which they knew the parties to cohabit giving the dates from personal recollection. The claimant has furnished the affidavit of but one witness in proof of widowhood whereas the testimony of two witnesses is required by the rules of the Office. That he so knew the said Luke Green from his boyhood to the time of his death That he so knew the said Nancy before her marriage with the said Luke Green and when her name was Nancy Murphy and still well knows her- that prior to and at the time of the reported marriage of the said Luke Green and Nancy Murphy deponent was living within three miles of their residence and in Berlin Rensalaer Co NY- that deponent was informed of said marriage about the year 1804- that about two months after deponent was so informed of said marriage the said Luke Green and Nancy removed from Berlin aforesaid and were reported to have removed to and be living at Brookfield Madison Co NY That in or about the year 1812 deponent visited in the county of Allegany NY and there saw the said Luke Green and Nancy Green and visited with them that they were then living together as husband and wife and had two or three children that within a short time after the deponent himself removed to Allegany County NY and located in the immediate vicinity of Luke Green and Nancy Green and well knew them from and after that time as aforesaid until the death of the said Luke Green about the year 1842- that during the whole of that time the said Luke Green and Nancy Green cohabited as husband and wife and raised in all a family of eight children four boys and four girls. Deponent further says that he was well acquainted with John Green who was the person reported to have married the said Luke Green and Nancy Murphy and that he was then acting as a Justice of the Peace and deponent thinks that at the time no record of marriages was kept by Justice of the Peace- deponent further swears that he has no interest in any claim founded in the whole or in part on this affiant. And the said Polly Green deposes and says that she was the sisterinlaw of the said Luke Green having married his brother- and that she has well known the said Luke Green since 1800 and his widow Nancy Green since about two months after their marriage- That she resided at Brookfield Madison Co NY when said Luke Green & Nancy Green moved then as was reported from, Berlin Rensalaer Co- that she has been well acquainted with them ever since. That she worked in the family for a while when they lived at Brookfield aforesaid and when they had one child and now live near the said Nancy Green at Alfred center NY and that the said Luke Green and Nancy Green cohabited as husband and wife until the death of the said Luke Green about 1842 and were the parents of eight children. Deponent further says that she has no interest in any claim founded in whole or in part on this affidavit. Deponent further says that the said Nancy Green now resides at Alfred Allegany Co NY and that she has not remarried since the death of her said husband Luke Green but remains his widow. Certified Affidavit by Nancy Green, 1872 State of New York Allegany County Nancy Green being duly sworn according to law deposes and says that she is the identical Nancy Green who is the widow of Luke Green and who is an applicant for pension under the act of Feb 14-1871. She further swears that she cannot furnish any higher evidence of her marriage with the said Luke Green than the affidavit of David Stillman and Polly Green accompanying this affidavit for the reasons that the magistrate John Green by whom the marriage ceremony was performed made or kept no record of the same as she has been able to ascertain and has long been dead and that all the eye witnesses to the said marriage ceremony who were eight in number to wit: Rhoda Spencer, Benjamin *****, Whitman Place, Mercy Place, Clark Green, Anna Green, Randall Spencer, and Rhoda ***** are now deceased. Certified Affidavit by Nancy Green, 1871 State of New York County of Allegany On this 12 day of June AD one thousand eight hundred and seventy one personally appeared before me Wm H. K. Russell County Clerk and Clerk of the Supreme Court a Court of Record within and for the county and state aforesaid Nancy Green aged 89 years a resident of the town of Alfred County of Allegany and State of New York who being duly sworn according to law declares that she is the widow of Luke Green who served the full period of sixty days in the military service of the United States in the War of 1812 and who was the identical Luke Green who enlisted as a substitute in Captain Barrows Company unknown Regiment unknown Brigade unknown Division at Almond Allegany County New York on or about the 1st day of December 1814. That he served as a private and that the last service by him ******* in said service was as one of an escort employed in ****ing prisoners from Black Creek to Greenbush NY that she was married under the name of Nancy Murphy to said Luke Green on the 23rd day of December AD 1804 by John Green a Justice of the Peace at Petersburg NY there being no legal barrier to such marriage. That her said husband died at Canton Illinois on the 29th day of April AD 1841 and that she has not remarried since his death= Reference is had to Bounty Land Warrant No 94101 issued from the office of the Commissioner of Pensions on the 27th day of July 1860 to this deponent as the widow of said Luke Green and the proofs in that claim to support this. That at no time during the late Rebellion against the authority of the United States did she or her said husband adhere to the cause of the enemies of the government giving them aid or comfort or exercise the functions of any office whatever under any authority or pretended authority in hostility to the United States. That she will support the Constitution of the United States- that she is not in receipt of a pension under any previous act-that she makes this application or declaration for the purpose of being placed on the pension rolls of the United States under the provisions of the act approved February 14th 1871 and hereby constitutes and appoints with full powers of substitution and revocation William H. Scott her true and lawful attorney to prosecute her claim and obtain the pension certificate that may be issued-That her post office is at Alfred Center County of Allegany State of New York- That her domicile or place of residence is Alfred Center. Soldier enlisted 5th August 1814, Discharged 2nd November 1814……..[blanks] Declaration and identification in due form, filed 16th June, 1871. SERVICE FOR SIXTY DAYS SHOWN AS FOLLOWS: Report from the Bounty Land Division states that Luke Green served in Capt. Barrow’s Co. NY Mil from 5th August to 2nd November 1814. Total service 90 days. Soldier died 29th April 1841; date and fact established by evidence on file in Bounty Land Division Continued widowhood since his death established by testimony of Amos Crandall and Amos Burdick. Marriage to soldier prior to February 17, 1815 established by affidavit of Amos Burdick who testifies that the parties cohabited since the year 1814 and of David Stillman who testifies that the parties were cohabiting in the year 1812. Widow gives date of marriage as 23rd Dec. 1804. Maiden name Nancy Murphy Oath to support the Constitution of the United States subscribed. Non-receipt of pension declared.
