Deeds, Holiday to Booker, 1854, Greene County, Illinois This file was contributed for use in the USGenWeb Archives by: Pat Johnson Greene County Illinois Deed Book Y Carrollton, Illinois Pages 114-116 Hiram Holiday, Adm to Booker's Heirs ---- Filed September 18,1854 This indenture made this 6th day of February in the year of our Lord One thousand eight hundred and fifty four between Hiram Holiday Administrator of the Estate of Berryman McGlothlin late of Greene County State of Illinois of the one part and heirs at law of R.M. Booker of the second part. Witnesseth that whereas at the October term of the Circuit Court of Greene County Illinois AD 1852 the following decree was entered by the Said Court in Chauncery In the matter of the application of Hiram Holiday administrator of the estate of Berryman McGlothlin late of Greene County Illinois deceased this cause came on for a hearing and it appearing to the Court that Hiram Holliday as administrator of the Estate of Said deceased has given public notice for six successive weeks previous to the first day of the present term of the Court in the Greene County Banner a public newspaper published weekly in the town of Carrollton in said County of the intended application to sell the real estate of Said deceased to pay the outstanding debts against Said estate. It also appearing to the Court that Daniel McGlothlin, William McGlothlin, Josephus McGlothlin, Vianna Holiday and Hiram Holiday her husband, Susan Foreman, Catharine Forrest & Beryamon McGlothlin, Sarah Barnes, Hercules McGlothlin, Elizabeth Dawson heirs at law of John McGlothlin dec\'92d, Josephus McGlothlin heir at law of Isaac McGlothlin deceased and Elizabeth Petty, William Petty, Elijah Petty, Benjamin Petty, and John Doir [Darrow] heirs at law of Elizabeth Petty deceased are the legal heirs of Berryman McGlothlin deceased and to also appearing to the Court that Elijah Petty, William Petty, Elizabeth Petty, Benjamin Petty and John Doir [Darrow] are minors the Court appoints James M Pursley, Esq. And attorney at law Guardian adtitem for said infants Said Pursley being in Court and consenting to serve filed his answer for Said infants and it appearing from an abstract filed that said Administrator that Said Administrator has filed an inventory appraisement and sale bill of the personal estate and personal property of the deceased and it also of appearing that the personal estate of the personal Estate of the Said Berryman McLaughlin, deceased is not sufficient to pay the outstanding demands against Said estate. Therefore it is ordered and decreed that the Said Hiram Holiday as such administrator make sale according to the statue in such case made and provided the real estate in the petition in this cause set forth and ___ or so much thereof as may be necessary to pay the outstanding debts against Said Estate being described as follows, to wit Lots 117,118,119 in the Town of Greenfield in Greene County Illinois also the North half of the North West quarter of South West quarter of Section No.9 in Township No.10 North of Range No.10 West of the principal meridian containing twenty acres. That Said administrator Sell Said described real estate to the highest and best bidder on a credit of Six months and that he execute deeds for the same and require note with good personal security and a mortgage on the premises Sold to Secure the payment of the Purchase money and also that he make report of his proceedings herein to the next term of this Court. And whereas at the September term of the Greene Circuit Court A.D. 1853 the following additional decree was rendered in the same cause Which Said decree was as follows it appearing to the Court that the Said Administrator has proceeded according to the directions of a decree herein before granted and Sold a part or the whole of the lands of which Berry McLaughlin died seized to pay the outstanding debts of Said deceased and that R.M. Booker became the purchaser of a part of Said lands and that before Said Administrator Executed a deed to the Said R.M. Booker departed this life therefore the Court Orders and decreed that the Said Administrator Execute a good and lawful deed of conveyance for so much of the lands of Berryman McLaughlin deceased as the Said R.M. Booker purchased to the heirs at law of the Said R.M.Booker. Now therefore I the Said Hiram Holliday Administrator as aforesaid in pursuance and by virtue of the foregoing Several decrees having sold according to Said decree in such case made and provided proceeded and Sold the following described real estate belonging to the Said Berryman McLaughlin dec\'92d ToWit Lots in the town of Greenfield Greene County Illinois known and designated on the first Said Town by No. One hundred and Seventeen One hundred Eighteen & 119. R.M. Booker being the purchaser of the Same. Now by virtue of the last mentioned decree and for and in consideration of the Sum of One hundred & fifty dollars & Twenty five cents I Such Administrator do hereby Sell and Convey to the heirs at Law of Said R.M. Booker the real estate above described to the heirs and assigns forever to Have and to Hold the same forever against the lawful demands of all persons whomsoever. In Testimony Whereas The Said Hiram Holliday Administrator as aforesaid have hereunto Set my hand and Seal the day and year above written. Hiram Holliday Administrator B. McLaughlin, Dec'd State of Illinois, Greene County Personally appeared before me this day, Hiram Holiday Administrator of B. McLaughlin deceased, who is known to me to be the real person who executed the above Deed and acknowledged that he Signed Said Deed freely and voluntarily for the uses and purposes therein mentioned .
