Wylder ---- Filed August 16 1853 This indenture made this day of January in the year of our Lord One thousand eight hundred and fifty three between Hiram Holiday Administrator of the Estate of Berryman McGlothlin deceased late of Greene County State of Illinois of the one part and William H. Wylder of the County of Greene and State of Illinois of the other part. Witnesseth that whereas at the October term of the Circuit Court of Greene County Illinois AD 1852 on a certain Petition the and there pending in said Court it was by the said Court ordered and decreed as follows to wit For the matter of the application of Hiram Holiday administrator of the estate of Berryman McGlothlin deceased for leave for an order to sell Real Estate of the Intestate. This ____ came on to be heard and it appearing to the Court that Hiram Holiday administrator of Said deceased has given public notice for six successive weeks _______ previous to the first day of this term of the Court in the Greene County Banner a public newspaper published weekly in the town of Carrollton in said County of the intended application to sell the real estate of Said deceased to pay the outstanding debts against Said estate. It also appearing to the Court that Daniel McGlothlin, William McGlothlin, Josephus McGlothlin, Vianna Holiday and Hiram Holiday her husband, Susan Foreman, Catharine Forrest & Beryamon McGlothlin, Sarah Barnes, Herculean McGlothlin, Elizabeth Dawson heirs at law of John McGlothlin dec'd, Josephus McGlothlin heir at law of Isaac McGlothlin deceased and Elizabeth Petty, William Petty, Elijah Petty, Berryman Petty, and John Doir [Darrow] heirs at law of Elizabeth Petty deceased are the legal heirs of Berryman McGlothlin deceased and to also appearing to the Court that Elijah Petty, William Petty, Elizabeth Petty, Beryamon Petty and John Doir [Darrow] are minors the Court appoints James M Pursley, Esq. And attorney at law Guardian adtitem for said infants Said Pursley being in Court and consenting to serve filed his answer for Said infants and it appearing from an abstract filed that said Administrator that Said Administrator has filed an inventory appraisement and sale bill of the personal estate and personal property of the deceased and it also of appearing that the personal estate of the Said Berryman McGlothlin deceased is not sufficient to pay the outstanding demands against Said estate. Therefore it is ordered adjudged and decreed that the Said Hiram Holiday as such administrator make sale according to the statue in such case made and provided of the real estate in the petition mentioned and described as follows, to wit Lots 117,118, 119 in the Town of Greenfield in Greene County Illinois also the North half of the North West quarter of South West quarter of Section No.9 in Township No.10 North of Range No.10 West of the principal meridian containing twenty acres. That the Said administrator Sell Said described real estate to the highest and best bidder or so much thereof as will be sufficient to pay the outstanding debts against Said estate on a credit of six months and that he execute deeds for the same and acquire notes with good personal security and a mortgage on the premises Sold to Secure the payment of the Purchase money and also that he make report of his proceedings herein to the next term of this Court. And whereas afterwards to wit on the day of January AD 1853 between the hours of Ten oclock AM & Six oclock PM of Said day. The Said premises having been duly advertised as the law directs the Said administrator openly Sold and Struck off to the Said William H Wylder the following described premises for the sum of one hundred and ten dollars he being the highest and best bidder for the same which premises so Sold are described as follows to wit. Being the North half of the North West of South West quarter of Section No.9 in Township ten Range ten containing twenty acres. Now therefore this indenture Witnesseth that the Said Hiram Holiday administrator aforesaid for and in consideration of the sum of One hundred and ten dollars to him paid by the Said William H. the receipt whereof is hereby acknowledged hath granted, bargained and Sold and by these presents doth grant, bargain, and Sell; convey and confirm unto the Said William H. Wylder his heirs and assigns forever the above described land with the appurtenances thereunto belonging to have and to hold the same with all the privileges to him the Said William H. Wylder his heirs and assigns to his use and their use and behoff forever. In Witness whereof the Said Hiram Holiday administrator as aforesaid hath hereunto Set his hand & Seal this day and year first above written. Hiram Holiday Administrator of the estate of Berryman McLaughlin State of Illinois, Greene County This day personally appeared before the undersigned, one of the Justices of the Peace and for Said Court, Hiram Holiday Administrator of the Estate of Berryman McLaughlin deceased acknowledged that he had executed the Same as administrator as aforesaid for uses and purposes therein expressed.
