It is my wish that Josiah my son have the home plase at the death of me and my wife for taken care of us the amt of land is 90 acres it is my wish that my son James have a certain pice of land laying between the Newport and Willmington roads north of Apple Creek Bridge. It is my wish that Land at the ford of the Creek bee divided between my Sons Elisha and Abosalum. Absolum to have the north forty and Elisha to have the south forty it is my wish the 80 in the East side of the home tract bee given to Susan and Sinthy My daughters the balance of my land north of Applecreek Bridge is to bee Equally divided betweene those designated above for timber lying north of the Willmington road it is my wish that my son John have five dollars and this to bee all that he is to have my son William is to have five dollars and this is his portion. all the Balance of my Effects is to bee equally divided betwene my other children my children living on the farm is to have all of their own property it is my wish that Dr J M Stout bee my Executor and settle up all of my business as I would doo my self. In Probate, Sept.Term, A.D., 1864 PERSONALLY APPEARED in Open Court, William D. Chinn and Green Driver subscribing witnesses to the foregoing instrument of writing, purporting to be the LAST WILL AND TESTAMENT of Benjamin Ogle late of Greene County, deceased, who being duly sworn according to law, do depose and say, each for himself, that the foregoing is the Last Will and Testament of the said Benjamin Ogle deceased; That they subscribed their names thereto as the attesting witnesses at the request of the said Testator, and in his presence, and in the presence of each other, on the 26th day of August A. D. 1864. That he then and there subscribed his name thereto in our presence, and declared the same to be his last will and Testament; and that the said Testator at the time of the executing the same as aforesaid was of full age, of sound mind and memory, and under no constraint.
