Will of James MULBERRY - Greene County, IL Know all men by these presance that I James Mulberry of the County of Greene and State of Illinois being of sound mind and memory Do declare this to be my last will and Testament and here By Revoking all other wills made by me. First it is my will that all my just Debts and funeral Expences Shall be Paid By my Executor. Second To my Son Jeremiah [m.i.=?] Mulberry I bequeath one hundred Dollars. Third, To my Daughter Delilah Harwood I bequeath the interest on a note that I hold on Edwin and Thomas Harwood and Allen B. Wood as Security the face of Said Notes three hundred Dollars. Fourth To my Daughter Polley Marshal I bequeath one hundred Dollars. Fifth To my Grand Daughter Lucy Mulberry I bequeath Fifty Dollars. Sixth To my Son John C. Mulberrys Heirs I give Devise and bequeath Forty acres of land which Shall be [??] on Mean ? by So. on the South East Corner of the tract of land now owned by me the Said John C. Mulberry and wife to live on the same and support themselves and family. Seventh To my son Frances J. Mulberry I give and Devise and bequeath Eighty acres of land in the tract of land now owned by me. Comencing at the North west corner and runing East to the North East corner of Said tract thence South thence west thence North to the place of begining and to contain onely Eighty acres of land. With this Provision that he Shal Quit Drinking for five years from and after my Death and conduct himself in a morral manner and if he Does not Quit Drinking during that Period of time My will is that the land bequeathed to him is then to be sold to the highest and best bider By my Executor and the proceds thereof to be divided Eaquely among my heirs. Eighth, it is my will that the Sixty acres of land owned by me in adition to the bequests allready made Shall be Soldd in order to enable me to have the provisions of this will carried out. Ninth it is my will that my Dear Wife Nancy Mulberry Shall have my house and lots in Woodvil the one containing the Residence and the other containing Stables to hold and Dispose of the Same as she may see proper Dluring her Widowhood and allso She Shall have a team of two horses and one Set of harness, one wagon and farming utencils Suficient to [.....] farm and also She Shall have a choice of the two cows and all the house hold and kitchen furniture that is Required for her to keepe house with to have and to hold During her life time provided She will take it in liew of her Dower. Tenth To my daughter [??} Wood and {??] A Rice Luce Ma Wood and Isabela Pigg I give and Bequeath three hundred Dollars in cash Each. Eleventh it is my will that all property of mine not provided for in this my last will Shall be Sold at publick Sale and the proceds to be applied to caring out the provisions of this my will and if there Should be a Surplus after fulfilling the provisions of Said will it Shall be Eaquely Divided among my heirs named in this will. H. Fields and John Darby subscribing witnesses to the foregoing instrument of writing, purporting to be the Last Will and Testament of James Mulberry late of Greene County, deceased, who being duly sworn according to law, do depose and say, each for himself, that the foregoing is the Last Will and Testament of the said James Mulberry deceased; That they subscribed their names thereto as the attesting witnesses at the request of the said Testator, and his presence, and in the presence of each other, on the 13th day of January A.D. 1865. That he then and there subscribed his name thereto in our presence, and declared this same to be his Last Will and Testament; and that the said Testator at the time of executing the same as aforesaid was of full age, of sound mind and memory and under no constraint.
