Last Will and Testament of James E JAMES, Jasper County, Illinois Contributed for use in the USGenWeb Archives Copyright 1999 Linda Flesch James E. James last Will and Testament May 12, 1871 I J.E. James of Newton in the county of jasper and State of Illinois, do hereby make and declare this my Last Will and Testament, in manners and form following to wit; First - It is my will that my funeral expenses, and all my just debts be fully paid. Second - after the payment of said funeral expenses and debts, I give and bequeath unto my beloved wife Jane James, the farm on which we recently resided, to wit; The N.W. quarter and NW SW quarter of Section 1 T. 7N. R 9E. also the North half SW quarter of Section 6 T. 7N. R10E. and the rents and profits of the same during her natural life. And I hereby give my wife full power and authority to sell and covey said farm, or any part thereof, and put the money at interest and use the same for her support, or use the principal if necessary for her support. I also give and bequeath unto my beloved wife, all of my personal property, Except the calf that is now on the farm which I give my son Gilbert James. I also give and bequeath unto my wife all money that may be on hand at my decease. Also all notes and accounts with full power and authority to use the same as she may think proper. I give and bequeath to my daughter, Sarah Melton the NW quarter of NE quarter of Section 25, also the SE quarter of NW quarter of Section 24, all in Township 8 North of Range 10E 80 acres. I give and bequeath unto my son Cyrus James Lot Number 2, NE quarter of Section 6 Town 5 North of Range No 14 West 101 acres. I give and bequeath unto my daughter Louisa A. Swartz the WE quarter of the NE quarter of Section 36 Township 8 North of Range 9 East40 acres. I give and bequeath unto my son Augustus James the East half of the NW quarter Section 29 Township 6 North of Range 14 West 80 acres. I give and bequeath to my son Gilbert James the West half of the NE quarter Section 22 Township 6 North of Range 8 East 80 acres. I give and bequeath to my daughter Laura James the SW quarter of the SW quarter of Section 33 Township 8 North of Range 10 East 40 acres. I give and bequeath to my son Alonzo James the SE quarter of the SW quarter of Section 23 Township 8 North of range 9 East, also the NE quarter of the SW quarter of Section 2 Town 7 North of Range 9 East. After the death of my beloved wife, I give and bequeath unto my sons and daughters as follows to wit; William H, Cyrus, Augustus, Mary J and Gilbert in Equal shares the above described farm on which we recently resided, upon the following condition that they pay, or cause to be paid to my daughter Laura James $300.00. Also that they give to my son Alonzo James $100.00 I give and bequeath to my daughter Laura James Lot #2 in Block #7 in the town of Newton, Jasper County, State of Illinois I give and bequeath to my son Alonzo James Lot #1 in Block #7 in Newton, County and state aforesaid, and in the event that there is no railroad constructed through said town of Newton, I give my wife Jane James full power and authority to sell and covey said Town Lots and put the money at interest for the benefit of Laura and Alonzo James, but not to be sold for less that $1,500.00 dollars, and the money put at interest of ten per cent until said children Laura and Alonzo James arrives at full age. And after the death of my wife, if there is any personal property remaining it is my will that the same be equally divided between all of my children. May 12, 1871 Judge James E.
